Too Many Battles to Fight

We have been blessed by the generous donations of many of our members and this support has allowed us to do much this year.

Just yesterday we agreed to step in to help a Georgia citizen convince the State of Georgia that our Constitution requires Presidential candidates to have TWO U.S. citizen parents. This challenge would have the Georgia Secretary of State keep Obama off the Democratic primary ballot because Obama isn’t a natural-born citizen. You can see our filing in that case on our web site. [LINK] If you read the motion, you will see the stunning argument by our sitting President that a popular vote of the people overrides Constitutional limitations. You will see our response to that argument on pages 7 & 8 of our filing.

This latest state action means that LLF has active legal challenges to keep Obama off the ballot in four different states. We’ve filed in Tennessee, Arizona, New Hampshire, and Georgia. We agreed to this latest action for several reasons. First, and most importantly, the judge hearing this matter appears to be impartial. Meaning we may actually get a fair hearing. Second, Georgia has clear election codes that require their Secretary of State to strike any candidate who isn’t qualified to hold the office sought. Third, Georgia code also explicitly grants Georgia citizens standing to challenge any candidate’s qualifications to hold office. Most states don’t have such codes.

Now for the frustrating news: we turn away requests for help every day. This is why we need your support. We’ve had several requests to file challenges to Obama’s Constitutional qualifications in Texas, Alabama, North Carolina, Florida, California, New Jersey, Michigan, and Virginia. I’m sure I’m forgetting some. This month alone we’ve gotten three requests for Liberty Legal to file amicus briefs in various cases. Just today we got another request in a case challenging the Constitutional basis for zoning laws which allows for the unconstitutional infringements of Agenda 21.

We want to take on these battles. We simply don’t have the resources to fight them all.

We are doing as much as possible with your donations. In addition to the certification lawsuits mentioned above, we are filing Supreme Court amicus brief on Obamacare in our attempt to get Wickard v. Filburn overturned. We’re still pressing the Federal Court in Texas to rule on our preliminary injunction in the OCA. On the immigration front, we’re also filing a Supreme Court amicus brief in U.S. v. Arizona. We will be the only group in that case to point out that the Obama administration’s policy violates existing Federal law. We are working towards helping groups in Alabama and Texas with their Obama ballot challenges.

Liberty Legal Foundation is very grateful for all the support we’ve received. But there are so many important battles that are not being fought simply because we don’t have the resources to fight them all. We want to do more. Please give what you can to help us continue our work to restore our Constitutional Republic. Thank you.

President Obama lied to me 10 times about healthcare reform. He said eight times that healthcare reform would be transparent and would be on C-span. Those were the first eight lies.

He said his door was "always open" to good ideas on healthcare reform. That was a lie. I knocked on that door.

He said all good ideas had been put on the table. That was a lie - an obvious lie to those of us who were keeping track of all the good ideas.

No wonder people have turned against Obama and ObamaCare. Especially since I have never seen an apology or an ounce of regret for the lying.

Those of us against ObamaCare and for healthcare that will empower patients instead of uncaring third parties are sometimes being heard. My first “Top Tweet” on Twitter was this one: ObamaCare means government can create an Orwellian future for you. Repeal it! #hcr #TeaParty #gop #tlot #tcot #tiot #ocra #sgp #tpp #ucot. It came up when I searched the healthcare reform hashtag, which is #hcr.

Good healthcare is about being in control of your own body. It's about having the power to make life and death decisions for yourself and your family. It's about having the money to spend on the healthcare that you want, not on what some figurative "death panel" will allow you to have.

Repeal ObamaCare. Make patients, doctors, and nurses more powerful and the uncaring third parties less powerful. Do healthcare reform right.

Important New Filings in the ObamaCare Class Action Lawsuit (OCA)

Fellow Constitutionalists,

Today Liberty Legal Foundation filed a motion for summary judgment asking the Federal District Court in Lubbock Texas to rule Obamacare, in its entirety, unconstitutional. We wanted to let you know right away, hence the mid-week update. You can read our motion on Liberty Legal’s web page - OCA Case Status.

We filed this motion now because over the past several weeks several rulings from other Federal courts, including the Supreme Court, emphasized that our argument is correct. Liberty Legal Foundation has been arguing from the beginning that ALL of Obamacare is beyond the scope of authority of Congress. We never limited our arguments to the individual mandate. Instead we’ve been arguing all along that the FDR-packed Supreme Court of 1942 destroyed the Constitution in its Wickard v. Filburn ruling.

Now, a year and a half after Obamacare was signed into law, Federal Courts are starting to say the same thing! I urge you to at least read the quotes from the 6th Circuit on pages 10 and 11 of our motion.

A couple of weeks ago I told you about the 11th Circuit and 6th Circuit decisions, one upholding the individual mandate and the other ruling it unconstitutional. Both courts had split decisions from their 3-judge panels. One was 2 to 1 upholding the individual mandate, the other was 2 to 1 finding it unconstitutional. What was amazing about the opinions written by these 6 Federal judges was that as much as they disagree, they all agree on the underlying problem. We have two courts, six judges, five separately written opinions, two opposing rulings, and a tie on whether the individual mandate is constitutional: three judges for, three against. Yet they all agree on one thing: Wickard made a mess of commerce clause precedent.

Now, with all that laid out, isn’t the solution obvious?! OVERTURN WICKARD!!

Fortunately this is exactly what several of the judges suggested. Even the judges that ruled the individual mandate constitutional noted that their ruling was because Wickard left no appreciable limit on Congressional authority.

So, with all this recent ammunition from sitting Federal judges, we decided it was time to go on the offensive. Rather than wait for our Federal court to cite Wickard, dismiss our case, and send us up the appeal ladder, we filed our own motion for summary judgment, citing all the great language from the other courts.

Understand that because we are asking the court to overturn Supreme Court precedent typical procedure would be to expect the lower court to dismiss our case, allowing us to appeal to the Circuit Court, then to the Supreme Court. Traditionally lower courts refuse to overturn precedent from higher courts, even when the lower court is completely convinced that the precedent is wrong. However, in my opinion tradition is less important than upholding the Constitution. The Constitution protects fundamental rights from government intrusion. Fundamental rights, granted to us by God, are more important than the traditions of men in black robes.

So, we asked the court to violate tradition and ignore Wickard, in favor of the clear meaning of the Constitution.

Of course we understand that judges are unlikely to throw aside tradition, so we also made an alternative request of the court. We asked the court that if it denies our motion for summary judgment, it also make that ruling immediately appealable with a statement about its opinion of Wickard. This way, if our judge agrees with us, as we hope he will, but he still wants to honor tradition over the Constitution, he can tell the higher courts what he thinks of Wickard and pass our case up the ladder with his statement attached.

Please understand just how unusual this motion is. Asking the Court to set aside this particular tradition amounts to legal heresy. I really can’t overstate just how much lower courts honor even the most ridiculous precedent from higher courts. However, this so-called doctrine really is just a tradition. Nothing in the Constitution, in any statute, or in any rule of procedure that I’m aware of requires it. Yet asking a court to ignore it is akin to screaming obscenities in church. It is simply not done.

However, our Founding Fathers stood up to the power of a King to establish our Constitutional Republic. Hundreds of thousands of men have died horrible deaths on the battlefield to defend our Constitutional Republic. Our Constitution protects the freedom that God gave to all of us, the freedom that made America great. With that perspective in mind, I can’t stand by and allow a mere legal tradition to delay our battle to restore our Constitutional Republic. I don’t think it’s asking too much of a Federal judge to stand up for the Constitution, even if it means violating a sacrosanct tradition and defying the higher courts in this one instance. A little rebellion is a good thing. Especially if it prevents a bloody revolution.

Our Constitution is Being Violated!

Dear Fellow Patriots,

Constitution Day was a disappointment for me. The Constitution is one of the greatest documents in the world and it's constantly being violated. Our Founding Fathers studied all the governments in history and tried to come up with the best Constitution possible for us, so that freedom could be eternally preserved. But we have not treated our Constitution with respect.

We need to repeal ObamaCare. Obama lied to me 10 times about healthcare reform and then he gave your power - the patients' power - away to uncaring third parties. That is wrong, because it's your life that is at stake.

We also need to overturn the Supreme Court decision in Wickard v. Filburn. This was the 1942 decision that said a farmer could not grow more wheat than was allowed by the government. This tragic decision has allowed the Government to enslave all of us with politically motivated commerce regulations.

Uncelebrated Constitution Day

Last Saturday was Constitution day. 224 years ago on September 17, 1787 our Founding Fathers signed our Constitution. That day was the first time in human history that a new government voluntarily codified the limits of its own power. This was certainly a high point in humanity's struggle for freedom.

The United States Constitution codified the fact that certain rights are given by God, as the Founding Fathers had first officially recognized years earlier in our Declaration of Independence. The Declaration and Constitution both recognized that God-given rights cannot be taken away by government.

Contrary to the modern teachings of our public school system, the purpose of the Constitution was not to simply set up three branches of government. It had a much more important purpose: to explicitly limit the authority of the Federal government, and to recognize that all remaining authority was vested in the people. In other words, God gives us Life and Liberty and Property. We then create government and give government some of our authority so that government can do certain things for us. You see, government is our employee. We have all the power. That is what the Constitution recognized and codified, for the first time in human history.

Unfortunately power corrupts. Those to whom we give our authority have turned it against us because they want to be the boss (sound familiar?). They now tell us what to do, when, how, why, how much… And they use our own authority to punish us if we resist.

It took generations, but our Constitution has been nearly destroyed because it has been forgotten. I have a calendar in my office that I got at an office supply store last January. Last week I noticed that Constitution day was not marked on my office calendar. “Peace Day” is marked. Every full moon is marked. Grandparents Day, First Day of Fall, Mexican Independence Day, Australian and New Zealand Labor Day, Daylight Savings, Kwanzaa, and many other days are marked on my mass-produced office calendar. But not Constitution Day.

This is why we have Presidents, Congressmen, Judges and Governors that ignore the Constitution. Because they can - because the Constitution has been forgotten. Because most Americans no longer know WHY it existed in the first place, or why it matters. This is what we must change.

Liberty Legal Foundation’s mission is to restore the Constitution through challenging flawed Supreme Court precedent. Part of the reason we chose that mission was because through high-profile legal battles we can raise awareness of how much America has lost. We can re-educate the people (and the courts) about what the Constitution says and does.

If we are to re-capture America’s greatness we must help America re-discover WHY it was great in the first place. Whether individual judges agree with us in court or not, we can educate Americans about the authority that comes to them from God, and only then, to government. If they understand that government has stolen the people’s authority and rights, we can get them back in the fight and we can re-establish our Constitutional Republic.

Michele Bachmann & Van Irion are Heroes Against ObamaCare

Michele Bachmann hit a home run against ObamaCare during the CNN Tea Party debates on September 12th, 2011. She did a great job explaining why, and how, ObamaCare must be repealed. It's not going to be easy. And it needs to be done via the 2012 presidential election. Everyone needs to rally around Michele Bachmann and all the Republican candidates on this issue. We must empower patients, not uncaring third parties.

Another hero against ObamaCare is attorney Van Irion in Tennessee. His most recent essay about ObamaCare is reprinted below with his permission. The bottom line is, even if your state has passed a nullification law against ObamaCare, it doesn't matter. Such laws are usually toothless. Read below to learn and see what you can do to stop the travesty of ObamaCare.

Toothless Nullification

Last Thursday the 4th Circuit Court of Appeals weighed in on the Constitutionality of the individual mandate. Actually, to be more accurate, the 4th Circuit ruled that it would not rule on the individual mandate. Instead it found legalistic rationalizations to avoid doing its duty. The 4th Circuit ruled that the State of Virginia doesn’t have standing to challenge the individual mandate. The 4th Circuit also ruled that Liberty University can’t challenge the individual mandate because the individual mandate is a tax, not a penalty.

Both of these rulings directly conflict with other Circuit Court rulings on exactly these issues. We now have disagreement between the 4th Circuit, 6th Circuit, and 11th Circuit regarding several issues. Again, this means that the Supreme Court is almost certain to take up these cases very soon.

While I disagree with the 4th Circuit’s ruling that the State of Virginia lacks standing to challenge the individual mandate, the ruling does highlight an important point: Virginia’s law nullifying the individual mandate is nothing more than political bluster from Virginia State politicians. Virginia’s nullification law has no effect in the real world because it has no means of enforcement.

Nullification is a Constitutional doctrine where a State or individual ignores a Federal law because the law is unconstitutional. Nullification is a valid and powerful Constitutional doctrine. Long ago the Supreme Court established that unconstitutional laws are void. A state nullification law is simply legislation passed by a state that expressly concludes that a specific Federal law is unconstitutional.

Unfortunately, all current attempts by state legislatures to use this powerful doctrine have failed because they lack any kind of enforcement mechanism. They leave no consequence for the Federal government if it ignores the attempted nullification. In reality these so-called nullification laws aren’t laws at all, they’re simply unenforceable resolutions.

To be a real law, as opposed to a resolution, a legislative act must include a consequence for failure to follow the law. In other words, if you can ignore the so-called law and nothing happens to you, it isn’t really a law.

Virginia’s so-called law nullifying the individual mandate, is a perfect example. The law essentially said that no Virginia citizen can be required to purchase health insurance. However, it did nothing to protect Virginia citizens from the individual mandate because it created no consequence for the Federal government if the Fed gov ignored the Virginia law.

The 4th Circuit’s ruling recognized this failure of the Virginia law. Because Virginia had based its standing claim on its toothless attempt to nullify the individual mandate, the 4th Circuit concluded that the State didn’t have standing. According to the 4th Circuit, because the Virginia nullification law doesn’t require or allow the State to take any action upon violation of its law, the State STILL has no legal interest in whether or not the Federal government enforces the individual mandate against Virginia citizens.

Again, I disagree with the Court’s ruling for reasons I won’t get into here. But their ruling makes an important point: the Virginia legislature failed its citizens. It publicly said that the Federal government is violating its citizens rights, but isn’t willing to do anything about it. Virginia said, we’re going to highlight this violation by recognizing it and publicly condemning it, AND we’re going to sit here and do nothing while it happens.

I admit that I’m being a little harsh toward Virginia. It did, after all, sue to prove that the individual mandate is unconstitutional. This is more than many other states did. But its lawsuit has now been dismissed because it failed to pass a nullification law that had any teeth.

My home state of Tennessee is in even worse condition. Tennessee passed an Obamacare nullification law, AND the Attorney General of Tennessee refused to join any lawsuit challenging any aspect of Obamacare. So, Tennessee is currently in the position of publicly acknowledging that the Federal government is violating its citizens Constitutional rights, AND it is actively doing nothing to stop the violation. Worse, its State legislators are patting themselves on the back for passing a meaningless nullification resolution.

Unlike other state legislators, Tennessee legislators can’t plead ignorance about the toothlessness of their nullification act. Last Fall and Winter Liberty Legal Foundation actively lobbied the Tennessee legislature to pass several nullification bills that all had teeth. The bills we supported were different because they created criminal penalties for violation. Our bills would have made it a felony for any government agent, Federal or State, to attempt to enforce any Federal law that has been nullified by the State. After enactment, these bills would have required local law enforcement to arrest Federal agents if they violated the nullification law. Liberty Legal was successful in getting two bills introduced into both houses of the Tennessee legislature, and getting several legislators to support these bills. Unfortunately both bills were killed in committee. We will be lobbying harder during the next session.

Nullification laws with provisions for arresting Federal agents would obviously lead immediately to court challenges between the State and Federal government. But that’s the point. The 4th Circuit just refused to rule on the Constitutionality of the individual mandate by claiming that the State has no legal interest in the individual mandate. If any State had an IRS agent sitting in a jail cell, or even passed a law allowing them to jail an IRS agent, legal standing would not be a problem. In fact, Obama’s Department of Justice would likely file their own lawsuit against the State the day after such a bill was passed.

Passing a nullification bill with teeth would force the Federal government to bring the battle to us. Currently we have States like Virginia and Tennessee passing toothless nullification bills and the Federal government’s response is to ignore them.

We Constitutionalists need to start fighting smart. Force the enemy to come to us. We hold the high ground. Yet we continuously fight on their terms. This is why Liberty Legal Foundation refuses to challenge the individual mandate alone. We insist that ALL of Obamacare is outside of the Constitutional authority of Congress. By doing this we take the fight to where we want it to be. We lobby for nullification bills with teeth, so that the Federal government can’t simply ignore nullification. Liberty Legal’s methods will force the Federal government to come to us. It will force them to justify THEIR arguments, rather than the other way around.

We need your help to turn this fight around. Please contact your state legislatures and insist upon State nullification laws that would criminalize Federal enforcement of unconstitutional Federal laws. My Review of The Undefeated Starring Sarah Palin - Excellent

I saw The Undefeated via Comcast Cable's On Demand service, and it was excellent. I rate it 10 Stars.

One cannot help but feel that they have finally met an honest, ethical and hard working politician in Sarah Palin. Interestingly, the undeserved vilification of Sarah Palin is nearly beyond comprehension, and it was a brilliant move showing all of that at the beginning of the movie.

Sarah Palin essentially stars as Jimmy Stewart in Mr. Smith Goes to Washington, except it's actually true, and you will feel the same warmth in your heart as you did when watching Jimmy Stewart. Everyone should see this movie.

Sarah Palin's values of free markets, fiscal responsibility, and limited government ring as true today as they did when our Founding Father's tried to give us a Republic - if we can keep it. Indeed, Benjamen Franklin reportedly warned when asked what America got after the Constitutional Convention: “A Republic, if you can keep it.” He was right to be worried. But heroes have emerged. Sarah Palin stood up against the travesty of ObamaCare, which empowers uncaring third parties instead of patients.

Sarah Palin continues to stand against socialism and crony capitalism and this film documents it all.

The rise of the Tea Party is well portrayed and accurately depicted as a movement based on freedom and liberty, not radical, but mainstream. The Tea Party members are people who actually balance their checkbooks.

The cast is amazing as well. They are very interesting people and shining stars. All of these people are in the movie:

The "Individual Mandate" Lightning Rod - is Fooling People

The "Individual Mandate" Lightning Rod

As an attorney you learn a little about negotiations: ask for more than you plan to get, including an outrageous demand far beyond what you have a right to ask for. Your outrageous demand acts like a lightning rod. The other party in the negotiation immediately focuses on your outrageous demand, telling you all the reasons it’s excessive. Of course you already know all the reasons they point out, but now your other requests (what you really want) seem much more reasonable and may be forgotten all together. Plus, you never know, you might get the outrageous item as well.

That’s why Obamacare included the individual mandate. The individual mandate was Obama’s "Lighting Rod". It was the outrageous overreach that they knew they’d probably never get to keep. I’m sure they’d like to keep it, and they hope to do so, but it was always intended to be their throw away. And it's working.

All the other lawsuits challenging the Constitutionality of Obamacare focus on the individual mandate. Only Liberty Legal Foundation’s Obamacare Class Action argues that ALL of Obamacare is unconstitutional. Yes, the individual mandate is outrageously unconstitutional. But it’s just the worst part of a big unconstitutional mess. Because all the other lawsuits focus on the individual mandate, the courts are also all focusing on the individual mandate.

You see, by creating such an outrageous part of Obamacare, the Obama Administration caused all the States and other litigants to give up their objections to the rest of Obamacare. It’s a brilliant tactic that has fooled most of America. Fortunately, all of you, the members of the Obamacare Class Action lawsuit, have avoided Obama’s trap. We’re keeping our eyes on the big picture. We will not be distracted by Obama’s slight of hand.

When Obamacare reaches the Supreme Court, Liberty Legal Foundation will be there to make sure that the most important argument is heard. Liberty Legal Foundation, representing all of you, will point out that the Supreme Court has the power to reverse its own precedent. It doesn’t have to follow old rulings like Wickard v. You are a racist if you believe in President Obama's class warfare instead of equality under the law.

A racist is someone who treats a group of people poorly because of who they are. Hitler believed in a "master race" and thus thought Germans should be treated well and everyone else badly.

Obama apparently believes that the "wealthy race" is evil, even though most or many of them are wealthy because they are productive. He is also willing to discriminate against the entire race of "non-union people" as displayed by his actions with the Stimulus Money and ObamaCare.

Other strong words can be used to describe Obama's class warfare, words such as bigotry, prejudice, and discrimination.

If you do not understand the moral principle that all Americans should be treated equally under the law, you are not a moral person. In fact, you are probably a bad person. America's best principles include opportunity and equality.

The Declaration of Independence from July 4th, 1776 is famous for this line: "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."

N. Scott Mills sums up what he believes this way: "I am classically liberal, or a Jeffersonian liberal, and I'm an individualist, individual and free, because I choose to be; I believe in individual and equal rights, equal laws, equal justice, and equal freedom. I believe Justice has to be blind to race, and all forms of social prejudices, for Justice to be equal. I believe nobody is above or below the law, and everybody should be treated equally under the law, with equal rights, and equal freedom, for everyone individually, so they can become whatever their abilities, aspirations, hopes, and dreams can create for them. I believe in the right of self-determination, over our minds, bodies, and souls, and that every one of us are free sovereign autonomous individuals. I believe the State or Government does not Own us, and therefore has no Right to make our decisions for us, or tell us what we can and cannot do with our own bodies, minds, and souls."

Individual Rights, States' Rights, Federal Rights, and ObamaCare

The Iowa Presidential debate included excellent signs of progress, and some very frustrating misconceptions about the Constitution. I was amazed and pleased to hear questions about the 10th Amendment and the role of government. Several times the debate moderators asked about the Constitution in relation to certain policy issues.

Folks, this is FABULOUS NEWS!! Never before in my lifetime has the Constitution been a significant part of a Presidential debate. The media and candidates are finally discussing the proper role of Federal government in the context of Constitutional limitations. I’m grateful for the efforts of the Tea Party movement, and people like you, for getting our so-called leaders to finally start asking the right questions.

Now for the frustrating part: The questions and answers last night revealed how far we have to go. I think we’ve gotten our proverbial ship turned in the right direction, but we’ve been off course for so long that it will take a while for us to get back to where we need to be. Several of the candidates discussed the 10th Amendment, state sovereignty, and Constitutional limits on the Federal government. However, they’re answers often revealed gaps in their understanding of these issues.

Let me pick on two of my favorite people as examples: Michele Bachmann was asked if it mattered whether or not an individual mandate was implemented by the Federal or State government in relation to the 10th Amendment. She answered "No" when actually it does matter. She could have used this question as an opportunity to show her Constitutional "chops". She understands that government at any level can't impose an individual mandate to purchase health insurance, however, her answer made it seem as if she didn’t understand the primary purpose of the 10th Amendment (to limit Federal powers and defend State authority). A more informative answer would have been, “Yes it matters. The 10th Amendment prevents the Federal government from implementing an individual mandate, it does not prevent States from doing so. However, other parts of the Constitution do protect individual Americans from such a mandate, even when it is a State attempting to force Americans to buy insurance.” Again, she may knows this, but she didn’t say it.

This may seem like picking nits, but it’s not. This is a VERY important point. Especially for a candidate like Bachmann. She’s running as a Constitutionalist. Her base voters are watching for signs that she can lead by example. Educating the American people about why and how the Constitution functions is a key job requirement.

Ron Paul answered essentially the same question next. He corrected Michele, by pointing out that States have the right under the Constitution to do “bad things.” He pointed out that the 10th Amendment protects States from Federal intrusion into State matters. However, he forgot the important point that the Constitution still requires the Federal government to protect certain fundamental rights of individual Americans against violation by government, even when it’s State government committing the violation. Again, Dr. Paul may know this, but his answer didn’t reflect such knowledge. Again, this is a VERY important point.

I know that candidate debates are stressful and it’s easy to give less-than-perfect answers. I’ve been a Congressional candidate and I’ve participated in televised candidate debates. I’ve certainly given an occasional answer that could have been better. But I also know that when it came to my core values, my answers were always dead on. They flowed from truths held deeply. I believe Dr. Paul’s and Mrs. Bachmann’s answers reflect understandings of the Constitution that are better than most, but still need some work.

The good news is that both of these answers reflect a quantum leap forward in the respect for the Constitution in our national debates. The fact that these issues were discussed at all is a victory for America. However, several answers in the Iowa debate reflect how far we have to go. Ron Paul and Michele Bachmann are two of the most sincere followers of the Constitution we have in Washington. I believe that they both truly desire to restore our Constitutional Republic. Yet even they apparently have some serious gaps in their understanding of how the Constitution is supposed to work, or have a difficult time articulating that understanding.

These gaps will be corrected, as long as we elect individuals who genuinely desire to follow the Constitution. If given the chance to run the country, either Michele or Ron will apply Constitutional principles to government. In doing so, they will continue to refine their own understanding of the Constitution.

So, the question for us is this: which candidates genuinely want to follow the Constitution? This question focuses on the deepest motives of the candidates. If you know what motivates a person, you can accurately predict what they will do under any circumstances. Pick a candidate that is willing to sacrifice themselves to protect the Constitution and you will find a candidate that will restore America’s greatness. They may make mistakes, but regardless of occasional mistakes, such a candidate would make great strides in the right direction.

Before you decide who to support in the upcoming elections ask yourself: “Would this candidate lay down their life for the country?” "Would they take a bullet?" We must support the candidate that is motivated by a genuine desire to save America, and is willing to give anything to achieve that goal. This is the first qualification that our next President must have. If they are also able to speak eloquently and motivate others, that would be great too, but it’s not as important as their proper motive to lead. All other “qualifications” are secondary to proper, self-sacrificial motives.

Countless soldiers have laid down their lives, often dying terrifying deaths far from home, in order to defend America. America has no chance to survive if we can’t find one Presidential candidate that has the same attitude toward his or her duty the country.

Based on personal knowledge I’m convinced that both Ron Paul and Michele Bachmann have the motives I’ve described here. I could be wrong. I don’t agree with either of them on every subject, and Michele has at least one vote that made me question her commitment to the Constitution. However, based upon what I know about her and Ron, I’m still convinced that their motives are pure.

I don’t know enough about all the other candidates to make the same judgment. I know MANY have proven that they are not motivated to restore the Constitution. Others may be. I simply don’t know yet. Whoever you decide to support, please consider their motives as the most important of qualifications.

How our Obamacare Lawsuit can solve the Debt Crisis

This week’s deal to raise America’s debt ceiling is a prime example of why we must restore our Constitution by overturning Wickard v. Filburn. The Federal government is not Constitutionally authorized to do most of what it does. Our crushing national debt comes primarily from costs associated with doing things that the Federal government shouldn’t be doing in the first place.

Our Founding Fathers never envisioned a government capable of regulating every aspect of our lives. In fact, such a government was exactly the type of despotism that the Constitution was intended to prevent. We now have a Federal government that tells us we have to buy health insurance, what type of light bulb we can use and how much water we can use to flush our toilets. It tells us that our children MUST go to school, and then it tells us what they must learn, what they CAN’T learn, and how it must be taught. Does anyone truly believe that this is the type of government that our Founding Fathers fought to create?

Every law, regulation, and tax passed by Congress requires countless Federal employees to implement, monitor, and enforce. All this costs money. So, the deal we get from the Federal government is this: give us your money so we can take your freedom.

America now owes over $14.5 Trillion. That’s over $46,000 per American (including children), or more accurately, over $130,000 per tax-paying American. The Federal government’s revenue is just over $2.2 Trillion per year. It currently spends $3.6 Trillion per year. Those numbers are beyond normal human comprehension. So, let’s put them into perspective: The average American household has an income of about $50,000 per year. If that average household ran like the Federal government it would spend $87,833 per year, and would already have credit card balances of $310,741. Do you see the problem?

The debt ceiling deal is exactly like this hypothetical household running into its credit limit, but rather than bringing its spending below its income, it raises its credit limit. This has been Congress’ answer to the national debt every time it has reached its credit limit. Rather than addressing the problem, Congress simply raises the credit limit. We all know where that ends.

America’s credit limit has a ceiling that cannot be raised by Congress, and we are about to bash our heads into it. As I said, Federal revenue is about $2.2 Trillion per year. (That amount changes depending upon the economy, inflation, and tax rates, but history shows that tax revenues never exceed a certain percentage of its gross national product.) We currently owe $14.5 Trillion. That’s more than 6.6 times our annual revenue. If the Federal government stopped spending a dime, today, it would take more than six and a half years to pay off our debt, and that is assuming no interest. That is if we spent $0 on defense, $0 on infrastructure, $0 on social security, $0 on medicare, $0 on Federal employees and $0 on everything else, and paid no interest on our debt. Do you see the problem yet?

Now let’s talk about interest on the debt. Interest on the debt is what creates a credit limit that cannot be removed by legislation. In the near future the interest payments alone will exceed Federal revenue. Interest payments alone for this year will be $412 Billion. That’s just under 19% of the Fed gov’s revenue. The Congressional Budget Office says that in about 30 years interest on the national debt will equal 100% of the Federal revenue. THIS is our absolute credit limit.

At this point 100% of the money collected from Americans will be needed to pay interest on debt alone. No defense, infrastructure, social security, medicare, education, welfare, unemployment, federal employees, or anything else will be paid by the Federal government. This, of course means that the Federal government would no longer be able to collect its revenue, because the Federal government would no longer exist. The real collapse would happen much sooner than this. Once the Federal government is forced to spend 50% or 60% to pay interest on the debt, it will seriously lose its ability to run the country. This will also force it to borrow more money, accelerating the death spiral.

The CBO’s estimate assumes that Congress won’t raise spending (yeah, right) and that global interest rates will not increase. If either of these things happen, and they both will, then the absolute credit limit moves closer to the present. This is why the debt debate is not a political debate. It's not really a debate at all. We are now dealing with hard economics that someday soon nobody will be able to deny.

All of this debt is a result of the Federal government doing things it isn’t Constitutionally authorized to do. If the Federal government was limited to its Constitutionally authorized activities, we would have no deficit and no debt.

If we succeed in overturning Wickard v. Filburn, Congress will be forced to stay out of most issues designated for State or individual control. If we succeed, Federal revenue will once again exceed its spending and we can make real headway towards paying down our debt.

We must return our Federal government to its pre-1942 mission. Without such a return to the Constitution, our country is doomed. We can do that with one victory: a Supreme Court ruling overturning Wickard v. Filburn.

The National Health Service is rationing care for hip replacements, knee replacements, and cataract surgery. These things are not essential services if you are the government; no, they are only essential if you are a patient.

Socialized medicine is where they take the patients' healthcare money and then ration care back to the patients after squandering much of the money with bureaucracy and incompetence. There is a maldistribution of care because patients no longer have choice or power.

Repeal ObamaCare. Empower patients instead of uncaring third parties.

Barack Obama is the Worst President in History

Obama lied to me eight times about healthcare reform being transparent and being on C-Span. That's right, he lied to you too. He lied about all good ideas being on the table and about his door always being open as well. When it comes to healthcare reform and economics, Obama is simply the Worst President in History.

Interestingly, the LEFT also thinks Obama is terrible as reported by Anthony Gregory, who I understand to be a Libertarian. I e-mailed Mr. Gregory and obtained permission to repost several paragraphs from his article: "Why the Left Fears Libertarianism" (http://lewrockwell.com/gregory/gregory217.html), which are well written and start here:

We Are Living Ayn Rand's Nightmare: A Socialist Takeover

We are living out Ayn Rand’s novel Atlas Shrugged right now. Businesses are on strike against bad ObamaNomics and the government is spending our future, our children's futures, and our grandchildren's futures.

The USA is undergoing the slowest recovery from a recession in history due to bad ObamaNomics. States are being driven into bankruptcy. Just like here, socialists are driving other countries into bankruptcy and then are rioting when their economies collapse under socialism.

The possibility of retirement is being made extinct by bad ObamaNomics. There is no evidence that Obama took enough economics courses in college to qualify to be president, and his lack of knowledge shows.

The Obama government is destroying liberty by failing to follow the constitution.

And the "lamestream media" is complicit, loving Obama like he is a messiah, instead of the worst president in history.

What are we going to do?

Atlas Shrugged Part I is a Masterpiece!

Atlas Shrugged is a fantastic movie. I rate it 10 stars plus. It’s actually as good as the book, which is an achievement that rarely happens. Thus, by reading the non-stop negative reviews, you can discern the almost complete and total bias of the mainstream media towards socialism and AGAINST freedom and capitalism.

Atlas Shrugged is an independent film, made for “only” $10 million (according to some sources), and is being self-distributed. Fast Five, the current box office champ, by comparison may have cost $150 million according to Hollywood Reporter. So, for 1/15th the cost, Atlas Shrugged is the clear winner, the underdog story, and the movie that actually means something. Atlas Shrugged could not have been done any better considering the constraints.

Atlas Shrugged is a huge book. Have you ever seen a movie based on a huge book succeed? Have you seen the Stephen King movie flops: Maximum Overdrive and Pet Cemetery? It’s not easy to turn an opus into a movie. Few are ever successful.

Kudos to John Aglialoro, a businessman, CEO, Chairman of a Company, and a poker champion for buying the film rights to Atlas Shrugged and making it happen. John Aglialoro is an American Hero.

Kudos to the screenwriters: John Aglialoro and Brian O’Toole. When I entered the movie theater all I could think about was: How are they going to handle this or that from the book? These two collaborators did a great job. With director Paul Johansson, the trio turned a literary masterpiece into a movie masterpiece, which is almost impossible to do.

Major Kudos to Graham Beckel, the actor who plays oil tycoon Ellis Wyatt. He’s terrific, as they are all, but he suffers against liberal Hollywood. About Hollywood he says, “Nobody talks to me anymore.” He also said, “…I’ve stopped working since I did Hannity.” One senses that freedom of speech is only okay in Hollywood when it’s not about freedom or liberty. His brother is a prominent democrat, so family events must be very awkward.

The first time I saw it, I thought the movie was great. It exceeded all expectations. I was stunned by how good it was for a low-budget, independently made, and distributed movie. I sat and watched all the credits. Most of us - strangers - in the theater got up after it was over and talked to each other about how amazing it was.

I’m going to see it again, and I never see movies twice. I literally can’t wait for Atlas Shrugged Part II, and Atlas Shrugged Part III. Finally, we have something that might reach the younger generation and wake them up as to how their power is being taken from them. See it two or three times yourself. Buy some tickets on the way out to support the cause of liberty and give them away. Buy the DVD when the movie theater run is over. Rent it from NetFlicks. This film is destined to be a classic.

Atlas Shrugged was so popular in Sebring, Florida that it is being held over for another week! You will not hear many good things in the “lamestream media” about Atlas Shrugged, because the movie supports freedom and liberty. So, at the very bottom, I list a few glowing reviews that I have seen.

Atlas Shrugged is a great movie. There has been no better example of the liberal media bias than their response to this fantastic movie. I give the movie 10 stars plus.

The movie is great. I was stunned by how good it was for a low-budget independently made and distributed movie. I sat and watched all the credits. Most of us - strangers - in the theater got up after it was over and talked to each other about how amazing it was. I Will Celebrate Sarah Palin's Birthday!

Sources say that Sarah Palin was born on February 11th. I will be celebrating her birthday and will be saying many good things about her in order to counteract the biased Main Stream Media, which seems to slander everyone who has the the three core values of 1. Van Irion on Repealing ObamaCare and Bad Precedent

Bradley,

Yesterday [1-31-2011] the District Court in Florida ruled that Obamacare’s individual mandate is unconstitutional. This ruling agrees with a recent ruling from the District Court in Virginia, but the Florida court went further by ruling that the individual mandate can’t be separated from the rest of Obamacare. So, the Florida Court ruled that the entire law was unconstitutional.

This conclusion should have been obvious since the Obama administration, its attorneys, and Obamacare’s proponents in Congress have ALL argued that the individual mandate is “integral” to the entire law. I was actually pretty disappointed with the Virginia Court when it found the individual mandate unconstitutional, but then found that it could sever the individual mandate from the rest of the bill. Now at least one Federal court has corrected that mistake.

I’m also disappointed that both Courts explicitly stated that Congress has the power to regulate health care and insurance. My immediate reaction was that both judges must be reading some other Constitution. The Constitution I have does not list “regulation of health care” within the enumerated powers granted to Congress. Then I remember, they’re following Wickard v. Filburn.

You see, District Courts work under the assumption that they must follow existing precedent from higher courts and rarely even consult the Constitution. Both the Virginia and Florida Courts were simply applying Wickard v. Filburn when they re-affirmed Congress’ general authority to regulate healthcare. This is why our Obamacare Class Action lawsuit must go all the way to the Supreme Court to get Wickard v. Filburn overturned.

Our Obamacare Class Action lawsuit is STILL unique because it is the only lawsuit against Obamacare that begins and ends with one argument: the commerce clause does not grant unlimited power to Congress, therefore Wickard v. Filburn must be overturned. I may sound like a broken record, but this message needs to be repeated until everyone in America understands it. For the first 150 years after the Constitution was ratified, all courts agreed that the Commerce Clause gave Congress only the authority to prevent individual states from implementing burdensome regulations on interstate commerce. Then the FDR-packed Supreme Court destroyed our Constitutional Republic by re-interpreting the commerce clause, eliminating all limits on Congressional authority.

The goal of all of the State-filed lawsuits is to get rid of Obamacare any way they can. That is an admirable goal, but it falls short of the more important goal. Liberty Legal Foundation’s goal is NOT simply to overturn Obamacare. Our goal is to restore Constitutional limits on Congressional authority so that when the political winds shift again, Congress can’t repeat a similar massive power grab.

Obamacare is simply the latest and worst example of Congressional abuse of authority. So, it became our tool to overturn Wickard v. Filburn. For 150 years the courts got the Commerce Clause right. For the past 68 years they got it wrong based solely on the political motivations of a handful of judges. There is more historical precedent supporting our arguments than supporting Wickard. This is a fight we can win! And success means Obamacare will be overturned AND our Constitutional Republic will be restored.

Tea Party Core is about Core Principles & Core To-Do List

One of my Facebook friends, Linda Hodges,

wrote me saying, " Brad, I completely agree!! I have lost a few "friends" along the way because they didn't like ONE LITTLE thing!! I see every day that too many people are "looking for a fight"!! That is not what I am about, and I agree that anything that pulls us apart is not a good thing! It is the CORE VALUES I want to preserve in our great Republic!! I will be joining the CORE group!!!!! Thanks again for everything!!"

This is why I have started Tea Party Core with a few of my friends. I believe the movement needs to focus on the three core values as published by the Tea Party Patriots:

1. Free markets

2. Fiscal responsibility, and

3. Constitutionally limited government

We also need to focus on a core "to-do list" so that our most important goals are accomplished. The Tea Party movement needs to remain united, and not let the smaller issues become divisive, as no two people can agree on every minor issue.

I think the TeaPartyCore.com website will be a great tool to help us do this. All my Tea Party friends that are good at technology will be invited, and hopefully we will make each member more powerful by using technology to leverage what we all do.

Proposed 28th Amendment to the United States Constitution

This message has come to me via e-mail several times:

Proposed 28th Amendment to the United States Constitution: "Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators and/or Representatives; and, Congress shall make no law that applies to the Senators and/or Representatives that does not apply equally to the citizens of the United States..."

I support this amendment. My e-mails on this topic also allege that:

"The 26th amendment (granting the right to vote for 18 year-olds) took only 3 months & 8 days to be ratified! Why? Simple! The people demanded it. That was in 1971...before computers, before e-mail, before cell phones, etc."

This is one of the ideas that I believe has wide support among WE THE PEOPLE, and is thus one of the goals of Tea Party Core at http://www.TeaPartyCore.com.

It would help return us to limited government.

I'd also like to know who deserves credit for coming up with the proposed 28th amendment.

On Dec. 16, 1773, the Boston Tea Party took place as American colonists boarded a British ship and dumped more than 300 chests of tea into Boston Harbor to protest against a government unrepresentative of the people. Today, as the Congress rushes towards a vote to thrust us deeper into debt and burden us with earmarks and pork barrel spending, we hope they'll think about the Boston Tea Party and all of its implications. Whether Congress remembers the country's history or not, Tea Party Patriots do, and we are watching them.

First some positive news: all your calls, emails and faxes are working. The pressure you have kept on Congress has held back this "Lame Duck" from passing several bills that would have disastrous consequences. It was also a very pleasant surprise that the Courts threw out key parts of Obamacare. Now the bad news, the US House passed a rule called the "Martial Law Rule." According to a house email sent yesterday to Congressmen: Martial Law: Members are reminded that last Wednesday, December 8, the Democrat Majority adopted a Martial Law Rule. This Rule allows for the consideration of any legislation, at any time, with very little notice, through December 18.

This means that the US House of Representatives & Nancy Pelosi can bring up and pass almost anything without notice - and according to GOP Leadership, Republicans can do nothing to stop them. Furthermore, we can expect them to pull out every liberal piece of legislation because they fear that the Left will NEVER come back into power.

In addition Sen. Harry Reid is threatening to keep the Senate till January 5th, 2011! Which means we must continue the fight through Christmas and New Years!
Game Plan

1. We must halt all bills till January, 2011. The best way for his a Senate Filibuster. This is when one Senator keeps speaking and does not let Senate bring up or pass any bills. An example would be similar to the James Stewart Movie "Mr. Smith Goes to Washington." Unfortunately, there doesn't appear to be many Senators willing to do this. Now is the time for guts. Two Senators that may do this would be Senators DeMint and McCain. PORK FILLED OMNIBUS BILL

It has become clear that the current Senate leadership and some Senate Republicans may be hearing impaired. They completely ignored the results of the November 2nd election by creating a pork fest with the Omnibus spending bill. Sen. John McCain has indentified over 6,488 earmarks worth 8 billion dollars in the Omnibus bill. According to FoxNews,
"Sen. John McCaintweeted the top 10 earmarks in the spending bill, including $247,000 for virus free wine grapes in Washington State, $413,000 for peanut research inAlabama, $235,000 for noxious weed management in Nevada and $400,000 for solar parking canopies and plug-in electric stations in Kansas.
McCain expressed disbelief about the projects.
"Are we tone deaf? Are we stricken with amnesia?" he said, adding that voters made it clear in last month's midterm elections that they're tired of business as usual in Washington."

If these things are not enough to tell how bad the bill is, realize this: the FDA power grab bill is inserted into the omnibus bill. That bill didn't pass before and needs to stand on its own. Again, those GOPers that voted against the FDA bill cannot in good faith vote for the spending bill.

Senators Tom Coburn and Jim DeMint are expected to make the Clerk of the Senate read the 1,924 page bill before a vote is taken. Please call and thank them and encourage them to do so.

This monetary easing is preventing recovery by devaluing the growth in savings and preventing self-reliance, investment at real market values and job creation. This Fed tactic makes all things in America more affordable to the rest of the world while pricing us out of the market because of supply and demand and a weak dollar for imports like coffee. We need to become more competitive rather then devalue everything we make and own, including our energy and food resources. Withdrawing taxpayer money from the market, paying down debt and contracting the monetary base will help to insulate the market from hyperinflation when real market demand growth occurs. We need market equilibrium and better market regulation, tax and oversight to increase adaptation, innovation and market efficiences. We need the correction in Housing that the Fed is trying to prevent from the government manufactured bubble. The Fed says this is a liquidity crisis when consumer demand is weak. Quit Extending Unemployment Benefits

We need to quit extending unemployment benefits. The real problem is that no jobs are being created because of bad economic policies instituted by President Obama. We need to quit extending unemployment benefits because we lose in at least three ways by doing so: 1. we lose a worker 2. the government has to pay for it, and 3. we go into debt to do it, making it even more costly.

It's better to rapidly turn the economy around by abolishing the minimum wage on all new hires, cutting taxes permanently, and eliminating red tape. These steps would 1. give someone a job 2. increase productivity, and 3. the government, i.e. the taxpayer, would not have to pay for it.

These steps would create jobs, and would help us to bring back manufacturing jobs to America.

Taxing the rich kills the economy. Each rich person is like a venture capitalist who can take risk and can invest in a business and create jobs. The less wealthy cannot take nearly so much risk with their money.

Even if the rich save their money, savings is often equal to investment. The money may be put into a bank, and that bank might loan out that money, creating seven times more economic activity than if the money was given to the government.

Neither Republicans nor Democrats have been able to stop runaway government spending; therefore, WE THE PEOPLE must do it.

How? By making politicians pay - not only at the ballot box, but also with their own money.

WE THE PEOPLE need to make politicians sign a pledge called “The Politician’s Pledge to Stop Runaway Spending,” which goes like this:

I [John Q politician] pledge that my congressional salary, benefits, and pension shall decrease 7% per year for every year that the national debt is not resolved. I shall also donate 7% per year of my net worth to the National Debt. Furthermore, after I pay my taxes, I will donate [50 - 100%] of my outside-of-congress income to paying off the national debt, and for three years after leaving Congress, I shall do the same. All my staff shall live by the same guidelines. I recognize that the purpose of this pledge is to keep me from enriching myself in congress while the country goes broke. Therefore my congressional service shall not result in any relative, company, surrogate, or associate of mine making money from my service in Congress. I will work for the people only.

Politicians must feel the pain they are causing us. The National Debt is nearly 14 trillion dollars. Each citizen owes nearly $45,000, and each taxpayer owes nearly $125,000, because politicians keep recklessly spending our money. Amazingly, politicians have spent all our money, all the kids’ money, and all the grandkids’ money. This will ruin our standard of living for decades.

Not only would I make politicians sign this pledge, I would insist that they make it a law.

Imagine if all the rich members of congress, such as Nancy Pelosi, John Kerry, Darrell Issa, and Jay Rockefeller had been forced to sign such a pledge by WE THE PEOPLE. According to the website OpenSecrets.org, the total net worth of congress is $3,750,403,958 - that’s nearly 4 billion dollars. This pledge would thus bring in $2,625,282 a year from their net worth alone.

There are 535 members of congress making $174,000 plus per year, or a total yearly congressional income of $93,090,000. Seven percent of that is $6,516,300 – another 6 to 7 million dollars for the National Debt.

Guess what? If they felt it in their pocket books, instead of just taking money from us, they would get things done, and fast.

The National Debt is not our fault. The average American balances their checkbook. This problem is entirely due to politicians. In 44 of the last 50 years – 88% of the time - congress has spent more than it has taken in.

We must make congress feel our pain because right now they are oblivious.

The Federal Debt is going to be our “Federal Death.” Drastic measures must be taken now to set our country back on a course to prosperity.

Budget Deficit Disorder is a real syndrome. We must treat the members of congress who suffer from this mental disorder with the harshest possible medicine.

We must light a fire under congress and their staff before we go from Superpower to "Super-Broke." Politicians must feel the pain as much as we do or they will never act.

A few people have discouraged me. Some have said, “Good luck with that plan,” implying that politicians would never cooperate. However, statistics show that the majority of the people are fiscally conservative. WE THE PEOPLE together have more power than Congress. We just need to organize.

Let's say to congress, “Cut the debt or we cut your income and assets.”

Perhaps this essay is not perfect. Perhaps you can improve upon it and I look forward to your comments and suggestions. There are many other important things we need to do to get the debt resolved, and I support those things, but I also think the general concept of this essay is sound.

We must let politicians know that we are not sending them to congress to get rich. We are sending them there to serve WE THE PEOPLE.

Velma Hart Has Lost Her Job to ObamaNomics

Obama laughed at Velma Hart. Now CBS News reports that Velma Hart got fired. Why? In my opinion, because Obama is incompetent at economics. Velma was right to be worried about eating hot dogs and beans again. She was right to be worried about not be able to afford private school for her two kids. In my opinion, Obama is the most incompetent president of all time when it comes to healthcare and economics. He has spent all our money, all the kids' money, and all the grandkids' money. Yet, he has not created the necessary jobs. Why? Because his policies are all wrong. He is killing businesses with ObamaCare, red tape, taxes, and uncertainty. If our president were competent in economics, Velma, and everyone else, would probably still have a job.

What Republicans Should Do About ObamaCare

Republicans should do something bipartisan for healthcare reform, something that will have the overwhelming support of WE THE PEOPLE.

They should give the power that was stolen from patients back to patients. They should empower patients, doctors, and nurses by ensuring that prices are no longer kept secret. It’s the secret prices that are the root cause of runaway healthcare costs and red-tape-bureaucracy.

Amazingly, there is a bipartisan, free market, capitalist solution, something you would expect from a Republican, yet, it was proposed by Dr. Steve Kagen, a United States Representative and a Democrat. Dr. Kagen put it in a bill called: “The Transparency in All Health Care Pricing Act of 2010” (or H.R.4700).

The bill simply says that WE THE PEOPLE have to be told the price of everything. No more secrets!

Dr. Kagen eloquently explained, “My patients, and my constituents, want to know the price of a pill before they swallow it - and certainly before they buy it.”

Dr. Kagen’s press release says: “The U.S. health care system has, for too long, tolerated the absence of transparent pricing. As a result, prices for prescription drugs, hospital services and insurance policies have gone through the roof.”

Price transparency is the single most important thing we can do to fix the health care system! It will give WE THE PEOPLE the power to make a difference again. It will allow competition, which will drive prices down, ensuring that more health care is delivered to everyone.

Don’t get me wrong, I am for repealing ObamaCare, instituting tort reform, and expanding medical savings accounts, but I don’t think this opportunity for price transparency should be overlooked.

Democrats should love “The Transparency in All Health Care Pricing Act of 2010” because it was written by a democrat and is endorsed by fifty-four democrats! Tea Party members, Libertarians, Constitutionalists, Conservatives, and Independents should love this bill because it empowers individuals rather than State or Federal governments. Republicans should love this bill because it is step toward the efficiency of the free market.

WE THE PEOPLE will love this bill because it reverses all the backroom deals and hidden prices by which patients are now being robbed.

It’s clear that ObamaCare must be repealed for the benefit of patients, because it does nothing about secret prices and robs patients, doctors, and nurses of lifesaving power. A better system should be created that will save more lives, and lessen suffering, by putting patients, doctors, and nurses back in charge. PRICE TRANSPARENCY IS STEP NUMBER ONE.

I am not a Republican or a Democrat. I have no party affiliation. I represent patients. My intention is to save the lives of more patients, and to better treat the agony of patients, not to promote any political party. Dr. Kagen appears to be someone who also puts patients first.

In fact, Dr. Kagen responded to me during the healthcare reform debate. Here is what he sent me via e-mail on August 5th, 2010:

This Act may be cited as the ‘‘Transparency in All Health Care Pricing Act of 2010’’.

SEC. 2. TRANSPARENCY IN ALL HEALTH CARE PRICING.

(a) IN GENERAL.—Any and all individuals or business entities, including hospitals, physicians, nurses, pharmacies, pharmaceutical manufacturers, dentists, and the insurance entities described in subsection (d), and any other health care related providers or issuers that offer or furnish health care related items, products, services, or procedures (as defined by the Secretary of Health and Human Services) for sale to the public shall publicly disclose, on a continuous basis, all prices for such items, products, services, or procedures in accordance with this section

(b) MANNER OF DISCLOSURE.—The disclosure required under subsection (a) shall—(1) be made in an open and conspicuous manner; (2) be made available at the point of purchase, in print and on the Internet; and (3) include all wholesale, retail, subsidized, discounted, or other such prices the individuals or business entities described in such subsection accept as payment in full for items, products, services, or procedures such individuals or business entities furnish to individual consumers.

(d) INSURANCE ENTITY DESCRIBED.—For purposes of this section, an insurance entity includes a health insurance issuer with respect to the offering of health insurance coverage, including in the individual market and small and large group market (as such terms are defined in section 2791 of the Public Health Service Act), a plan sponsor with respect to the offering of a group health plan (as defined in such section 2791), and entities responsible for the administration of governmental health plans (including the Centers for Medicare & Medicaid Services with respect to the Medicare program under title XVIII of the Social Security Act, State agencies responsible for administration of State plans under the Medicaid program under title XIX of such Act, or State child assistance plans under the State Children’s Health Insurance Program under title XXI of such Act, and the Office of Personnel Management with respect to the Federal Employees Health Benefits Program under chapter 89 of title 5, United States Code).

The 7% Solution to Our Economic Crisis – Make Politicians Pledge Their Own Money!

The solution to our economic crisis is simple: take money from politicians. After all, they have been stealing it from us their entire careers.

Republicans and Democrats have been unable to stop runaway government spending. So, since we are 13 trillion dollars in debt, WE THE PEOPLE need to “help them” stop spending. We can no longer afford to have every innocent baby in this country born over thirty thousand dollars in debt. We can no longer afford to have the government spend 7 million dollars per minute every minute of every day.

“The 7% Solution to Our Economic Crisis” is simple: the salaries, benefits, and pensions of the president and congress will be cut 7% per year until government spending is reduced enough to balance the budget and rid us of debt. In addition, any outside income received by politicians while in office, after taxes are paid, must be given to the government to offset the debt. And finally, any income above their average income while in office, for a period of two years after leaving office, must also be given up to the debt.

This simple plan will force politicians to be public servants instead of get-rich-quick carpetbaggers. Let me make a prediction: if this plan is implemented the budget will be balanced at an impressively fast rate.

This is the only way that our politicians will have enough backbone to actually cut runaway government spending. THIS HITS THEM IN THEIR POCKETBOOK. In seven years the politicians will take a 49% hit in their salaries, benefits, and pensions if they have not reduced government spending enough to balance the budget and rid us of debt. In 14 years the politicians will suffer a 98% reduction in pay if they have not done their job.

All fiscally responsible people, Republicans, Democrats, Libertarians, Tea Party members, Independents, and the undecided should get behind this plan before it’s too late. All the people in America, who actually balance their own checkbooks, should support this plan - as should fiscally responsible people from all the other political parties in America that I have not mentioned.

Let’s face it, the Republicans and Democrats are too busy fighting each other for power in Washington D.C. to fight for us. It’s WE THE PEOPLE that have to use our power, before it is taken from us forever, to fix things.

Let’s be clear on the rules: our budget must be balanced by reducing spending, not by raising taxes. It is runaway wasteful spending by both parties that is the problem. We have plenty of taxes already. As John F. Kennedy, a tax-cutter, said, “…an economy constrained by high tax rates will never produce enough revenue to balance the budget, just as it will never create enough jobs or enough profits.”

My unscientific poll shows that “The 7% Solution to Our Economic Crisis” is unpopular with politicians. In other words, it's the ideal program for WE THE PEOPLE to control our government.

From this day forward, we should not elect any politician that does not sign a pledge to abide by “The 7% Solution to Our Economic Crisis.” And when all these pledge-signing politicians are elected they should make it the law of the land. We should do this on the Federal level and then state by state starting with the bankrupt ones like California, Illinois, and New York.

By accepting the “The 7% Solution to Our Economic Crisis” for out-of-control government spending our politicians can demonstrate that they are really devoted to helping our economy, instead of seeking power, money, and glory for themselves.

A word of warning is that there will be crises in the future. When there is a crisis we must turn to freedom, not socialism. When there is a FINANCIAL crisis, we must turn to freedom, free markets, and capitalism, not socialism.

I recognize that this plan may need a few tweaks to make it practical. Feel free to tweak it as long as you do not destroy its soul. And I realize that we must add a few other practical things such as:

1. Each congressional bill must begin with a clearly stated purpose. Each bill can be on one subject only so we can stop the corrupt attachment of political earmarks. Each bill must cite where the constitution allows for such a bill. Each bill must be published online for two weeks so WE THE PEOPLE can read it prior to it being voted on, unless a true emergency exists.

2. Congress must agree to be held to all the same laws to which they hold the American people. No more letting congress exempt themselves from things like ObamaCare.

3. We must continue programs such as YouCut so that the WE THE PEOPLE can “help” our politicians cut spending by making them recognize their stupidest and most wasteful programs.

The “Death Panels” are Real and Exist Now

Please stop ObamaCare by voting out everyone who voted for ObamaCare on November 2nd.

I have seen the “death panels.” They are Medicaid, Medicare, and the Veterans Administration. They share one thing in common, they are run by the government. The “death panels” are government bureaucrats who come between you and your physician and, after being fiscally incompetent, ration, delay and deny care.

Medicare can deny a patient an antibiotic, even if five doctors recommend it. Medicare can deny a cancer treatment simply because it hasn’t made it on a list yet. Medicare denies patients, to quote Medicare: “regardless as to medical necessity.”

Medicare and Medicaid are no way to run health care. We know government health care is defective. We are the richest, most powerful country in the world. We have technology now that has never before existed, so let’s create something better than any health care system in existence now.

When Insurance companies succumb to crony capitalism the same thing occurs - “death panels” again. The “death panels” are insurance companies coming between you and your doctor. On the other hand, insurance companies that work properly are a driving force behind the greatest health care in the world, which we have in America today.

The World Health Organization's rankings placing the USA 37th in the world are bogus. Read the book, How to Lie With Statistics" and then read the WHO data, as you could not have a better example of lying with statistics. The World Health Organization is acting like a socialist organization with an anti-capitalist agenda.

Health care reform seems so easy to us physicians who have seen patients die or suffer because of the health care system. The solution is to make patients, doctors, nurses, and allied health care professionals more powerful and the Government and crony capitalism less powerful.

Sarah Palin said on Facebook: “The America I know and love is not one in which my parents or my baby with Down Syndrome will have to stand in front of Obama’s ‘death panel’ so his bureaucrats can decide, based on a subjective judgment of their ‘level of productivity in society,’ whether they are worthy of health care. Such a system is downright evil.”

Then, President Obama proved Sarah Palin right when he made a deal with Union leaders, so that they would not have their Cadillac Health Care plans taxed like other Americans. Apparently, non-union members can suffer and die on lower quality health care plans, while unions members “based on a subjective judgment of their ‘level of productivity in society,’” are deemed more worthy than everyone else - because they are mostly Democrats.

I am not partisan. Both parties are good and bad. Both have good ideas and bad ideas. They are not important to me. Patients are. Socialized medicine is not the best system. Crony capitalism is not the best system either. The answer is to make patients and health care providers more powerful. This can be done. However, the the best ideas for health care reform were ignored by Barack Obama, Harry Reid, and Nancy Pelosi.

Sarah Palin was right about the "Death Panels" no matter how many times the leftist media lies about it.

Needless to say, I will not be trusting those people for any future fact checking. I didn’t see any evidence that they asked the people who would actually know the inside secretive information by which our current “death panels” function - the doctors and nurses.

Perhaps the best comment I read on this controversy was on a blog:

“I love all these media moguls saying the bill doesn't set up that panel. Well no kidding. Bravo, media, give yourself a pat on the back for being so smart. It's a term, idiots, coined by Palin for the inevitable outcome, not language from the actual bill itself. Don't get me wrong, the framework for such a thing is in the bill.”

That blogger, pen-named Uffda, is exactly right. Government health care invariably goes bankrupt as Medicare and Medicaid have. Government health care is also incompetent, corrupt, inefficient, stifling of innovation, and results in rationing, lines, denials, delays, and the figurative “death panels” that Sarah Palin wrote about.

That’s why socialized medicine is so evil. Crony capitalism is also evil. Stop both those evils and put patients, doctors, nurses, and allied health care professionals in charge, not third parties.

Sarah Palin also wrote that “Rep. Michele Bachmann highlighted the Orwellian thinking of the president’s health care advisor, Dr. Ezekiel Emanuel, the brother of the White House chief of staff, in a floor speech to the House of Representatives. I commend her for being a voice for the most precious members of our society, our children and our seniors.”

I have read Dr. Ezekiel Emanuel’s articles in the medical literature and I agree with Michele Bachmann and Sarah Palin on this issue. I think he has horrible ideas. The worst part is that he doesn’t understand why, claims he is misquoted, and is taken out of content. He seems to be a clueless collectivist and I blame him for many of the deaths that occur every day in America because of the policies he writes about. He should not be a “bioethicist” for our NIH.

Sen. Chuck Grassley told us to fear that the government would "pull the plug on grandma." He was right for all the same reasons that Sarah Palin was right about “death panels.” Government health care takes Grandma’s health care money in taxes all her life and then when she wants to use it for her needs, it’s too late, it has been redistributed to other people, and her health care is rationed, delayed, and denied by the government.

I know elderly patients. I know they don’t want to die early because of a bad health care system. People want to live. People fight to live. People are beautiful and uplifting in their struggle to survive.

Obama dismissed “pulling the plug on Grandma” as dishonest. He said:
“I just lost my grandmother last year. I know what it’s like to watch somebody you love who’s aging deteriorate, and have to struggle with that,” Mr. Obama said. “So the notion that somehow I ran for public office, or members of Congress are in this so they can go around pulling the plug on grandma? I mean, when you start making arguments like that, that’s simply dishonest.”

Obama also suggested to a woman that her elderly mother probably shouldn't have received an expensive pacemaker, implying that she should have probably taken a pain pill and died instead. This is the secret that Obama doesn't get. It's not his money and it's not his decision - it's the patient's. Obama keeps wanting to make "We" decisions. The decision belongs to me, myself, and I when I am a patient, not the Government. The elderly mom, by the way, lived for five more years.

“Pulling the plug on grandma,” on grandpa, on mother, father, brother, sister, child, wife, and husband is exactly what occurs under socialized medicine. It happens under Medicare right now because of bureaucracy, fraud, and waste, and because Medicare stifles innovation, science, and the free flow of information patients need to make decisions.

Obama has scared to death many people who believe that Obama’s bureaucrats are going to take over life and death decisions from patients. HE HAS CERTAINLY SCARED ME.

I want to thank you Sarah Palin, “The Greatest Truth about Health Care Reform” was spoken by you in 2009. We can only hope that you have single-handedly saved us from the “death panels” of socialized medicine, and of Medicare and Medicaid for all. “Death panels” will be created if we create an inept health care system - whether public or private.

I also want to thank Senator Chuck Grassley for telling people to fear “Pulling the plug on Grandma.” He couldn’t have been more correct.

My prescription for patients is to fight “tooth and nail” to repeal ObamaCare and have “patient power” health care reform passed instead. Your life is at stake. It's not politics with me; it's life and death.

It was widely reported that Danny Williams, head government official in Newfoundland, skipped ahead of the lines in Canada (a government single-payer system) and went to Miami Beach for heart surgery at Mount Sinai Medical Center. He wanted minimally invasive surgery that he could not get in Canada. "This was my heart, my choice and my health," Williams was widely quoted as saying. Mr. Williams was right to leave Canada, as innovation and choice slow down, and sometimes disappear, under government health care.

ObamaCare "Death Panels" Are Real - 52 Days Left Until Election

Almost every day I see people say that Sarah Palin's figurative "death panels" are a lie. As a physician and economist, I know better.

The "death panels" are real. ObamaCare needs to be repealed and we need to empower patients, doctors, and nurses instead of third parties. Right now Medicare denies people treatment, in their own words, "regardless as to medical necessity." That's no way to run health care.

Please do all you can to see that ObamaCare is repealed. It's not politics, it's lives that are stake. There is a far better way to do health care reform.

President Obama has proven himself to be the most incompetent president in history. If you don’t believe me, I refer you to ObamaCare and the economy.

Remember when Obama promised us that if we let him spend all our money his way with the $787 billion economic stimulus that unemployment would stay under 8.5 percent?

Well, unemployment is at 9.5 percent, and the “real unemployment” rate may be as high as 22 percent.

Commentators from both political parties on shows like the McLaughlin report say unemployment won’t get back down to 6 percent for years at least five years. Teenage unemployment is 26.1 percent according to the bureau of labor statistics and Obama is almost entirely to blame for this dismal situation. The young and idealistic voted for “hope and change;” they got unemployment instead.

Young people need to remember this lesson as they suffer what may turn into a lost decade: Obama's socialist economic policies do not work.

Things are not too great for the older crowd either. According to Fidelity Investments a record number of workers made hardship withdrawals from their retirement accounts in the second quarter of 2010 and the number borrowing from their retirement accounts is at a 10-year high. This will destroy people’s retirement incomes.

Here is what Obama has done wrong:

1. Obama spent all our money bailing out Wall Street, General Motors, Freddie Mac, Fannie Mae, greedy corrupt Banks, and socialist unions
2. Obama raised taxes
3. Obama raised the minimum wage
4. Obama increased red tape and bureaucracy
5. Obama raised expenses with a ridiculous bill called ObamaCare

According to some sources, Obama has spent more of our money than all previous presidents combined. According to the U.S. National Debt Clock, the national debt is now over 13 trillion dollars and is increasing at a rate of over 4 billion dollars per day.

According to theObamaDebt.com, Obama has increased the deficit by $2.6 trillion in only 1.6 years. According to the bipartisan Congressional Budget Office, the Federal Debt is projected to grow to 62% of Gross Domestic Product in 2010, twice what it was in 2007. Under one scenario, the debt could reach 100% of GDP around 2025, and could be nearly 200% of GDP around 2035.

The Congressional Budget Office Director’s Blog warns that the debt could “…rise to unsupportable levels….” The blog talks about a “tipping point” at which a financial crisis is “likely or imminent.”

Cash for Clunkers was a failure. The General Motors bailout was a huge mistake. It did nothing to bring back cars, toys, computers, textiles, the steel industry, and call centers from overseas.

The homebuyer’s credit stimulus plan was a failure. The housing crisis continues. In fact, home sales are now at a 15 year low.

Did I mention that socialist economic policies do not work?

After promising health care hearings would be on CSPAN eight times, Obama, Harry Reid, and Pelosi passed ObamaCare via cloture against the will of the American people. ObamaCare transfers power from patients, doctors, and nurses, to the government. ObamaCare actually did create the figurative “death panels” Sarah Palin warned us about, and actually does “pull the plug on grandma,” as Senator Chuck Grassly warned us about.

What did ObamaCare do for businesses? They are writing off millions in projected costs. They are anticipating rising health care costs because ObamaCare failed to address the number one issue in health care – price transparency. Businesses are laying people off because of ObamaCare.

A Russian immigrant, Ayn Rand, warned us about all this.

In Atlas Shrugged by Ayn Rand, John Galt was a businessman who got all his colleagues to “shrug,” and quit being productive, stopping the engine of capitalism, until socialism was overthrown.

John Galt symbolizes the businesses of America. Obama has succeeded in getting the businesses of the USA to “shrug” and shut down because of his socialist economic policies. Business people don’t like deficit spending, higher taxes, red tape, unions so powerful that secret votes are not allowed, increased risk, increased uncertainty, and they don’t like the fact that instead of ending the “Great Recession” he has extended it by years with bad economic policy. Small businesses won’t hire, invest, take risks, or expand under ObamaNomics.

Business people have essentially shut down the “engine of capitalism” because of Obama.
We can only hope that the people will understand the lesson and return to free markets, freedom, and liberty.

Here is what President Obama needs to do to save our economy:

1. Quit spending us into bankruptcy
2. Slash taxes
3. Remove government obstacles to starting or expanding a business
4. Abolish the minimum wage - at least on all new hires (far less expensive than going into debt to pay unemployment benefits)
5. Repeal ObamaCare and do health care reform that will empower patients, doctors, and nurses instead of uncaring third parties and bureaucracies.

Obama has been in office nineteen months. A competent president would have turned the economy around by now. If Obama does not wake up soon, a lost decade of “no jobs and no growth” will ensue, just like happened in Japan in the 1990s when government bailouts were repeatedly used to bail out companies that were “too big to fail.”

Yes, President Obama has met John Galt. But, has he learned his lesson?

I was just talking to a friend of mine who lives in Germany/Sacramento and she was telling me that she is going back to Germany on Saturday to be with her mother because her mother is so ill. It has something to do with an aneurysm. She called to see if I wanted to go for lunch today before she takes off for Germany. She was telling me that the Americans are going to be so shocked when their new socialist health-care system gets put in place.

She said Americans have no idea how a socialist health system doesn't work for the people. It's a system that is run by basically government workers, including all those working in the hospitals. She was telling me about some of the things that happened to her mother who is in a hospital in Berlin.

Her sister's over there now and the two of them spoke the other night on the phone. She told me they were having a hard time getting anyone to operate on her mom because her mother is past that magical age. She also said that the "government workers" forgot to give her mother the antibiotic she needed for the past four days so now an infection that she had has been able to blow itself way out of proportion.

She said there's nothing you can do about that because they're all state workers, you can't get them fired, you can't sue them, you can't do anything. Even if one of your family members died. You have no recourse whatsoever. Then she went on to say that if you told the average American about this they would just say to you, yeah that's in Germany, but that kinda stuff won't happen to us over here.... her name is Dagmar and she's a really super gal who's been living in the United States for a few years now, but before that she grew up in socialist Germany. She thinks the average American is just a blind stupid idiot. But they're about to get a lesson she said.

And you didn't think there was such a thing as "death panels" in Obamas socialist health care plan.

Her mother has already been taken to two different hospitals and they're going to have to have her transported out of Berlin to some other small-town where they hope to be able to get her mother the treatment she needs. They're going to have to pay the costs out of their own pocket to a private physician, which is an awful lot of money, but what else can they do?

And you didn't think Obama knows exactly what he's doing... why do Americans think he didn't want Obama care put in place until AFTER the 2012 elections... why do most Americans think that ... Nancy Polosi said we won't know what's in it until after it's passed... none of them will tell us what's in it until 2013 because they know if we really knew, their asses would be had... IMMEDIATELY!

I would think the next few years in the United States are going to be, at the least, most incredible to watch.

If the tea party doesn't stomp that whole socialist movement in November and 2012, I'm afraid to think that the party is over...

I have just finished reading Glenn Beck's Common Sense: The Case Against an Out-of-Control Government, Inspired by Thomas Paine and I'm giving it a 5-star review. It's a great book.

It's a New York Times Bestseller. It's published by Mercury Radio Arts/Threshold Editions, which is a Division of Simon & Shuster, and it's a 167 page paperback.

It should be read by every Tea Party member, every patriot, and every child as part of their education.

One of my favorites quotes from the book is this one:

"The government by, of, and for the people has been turned on it's head. It is now a government by the government, of the government, and for the government - the people be damned." - Glenn Beck in Common Sense

Common Sense is an entertaining history lesson by Glenn Beck and it's loaded with facts. There are 5 pages of references listed at the end of the book.

The last 52 pages are a reprint of the original Common Sense by Thomas Paine. My favorite quote was that section is this:

Is the younger generation finally waking up? I was talking to a 22-year-old waitress and asked her: "What does your generation think of Obama now?" She said her friend says it profanely, but in essence the sentiment is: "I voted for Obama and now I hate myself."

According to the Bureau of Labor Statistics, the number of unemployed persons is 14.6 million, and the unemployment rate is nearly 10%.

The unemployment rate for all those teenagers, who mostly voted for Obama, is 26.1 percent.

That's what Obama-nomics has done for us. Obama is the most incompetent president since FDR spent everyone's money. Socialism does not work.

The way to turn the economy around overnight is to abolish the minimum wage, abolish most taxes, and stop interfering with the free market. We could have used this crisis to bring back the manufacturing of cars, steel, textiles, computers, and toys to this country, but instead Obama has turned us into Japan with years of inadequate growth expected.

We could have used this crisis to let teenagers work instead of join gangs, do drugs, and get frustrated, but instead the President made sure they would need welfare.

Maybe the young people are waking up. With one wrong move after another, Obama has extended the worst economy since the great depression. They voted him in - now good luck finding a job.

The team that brought you the Obamacare Class Action lawsuit (OCA) is forming a non-profit legal foundation to continue our fight to restore the Constitution - the Liberty Legal Foundation. This week we’re filing the documents to form the foundation and officially request tax-exempt status from the IRS. The LLF will take over prosecuting the Obamacare Class Action lawsuit. It will also be filing other lawsuits with the intent of forcing the Federal government to follow the U.S. Constitution. While I did not win the Republican primary for TN03, I will continue the fight for our Constitution with all the resources I can muster. The LLF will be a great resource.

While these lawsuits serve to fight the Federal government in court, they also draw public attention to governmental abuses of authority and violations of our Constitution. As the Arizona legislature proved, the best way to fight the liberals is to use the liberal media against itself. Before the Arizona anti-illegal immigration law was passed, most Americans were not talking about illegal immigration. Now it is the top issue in the news. Our foundation will use the government courts and the liberal media to fight against the courts and the media. Every time we annoy the liberal media they talk about us. When Americans start talking to each other we learn that most of us agree: the Constitution is being ignored and it should be restored. I have set the communism clock to one minute before midnight.

Midnight is the tipping point when I believe that our economic policy will be so incompetent that a slide into communism is inevitable.

When there is a crisis, turn to freedom, not socialism. When there is an economic crisis, turn to free markets AND capitalism, not socialism.

Unfortunately, when “the worst economic crisis since the Great Depression” arrived, President Obama, Harry Reid, and Nancy Pelosi turned to socialism.

Obama-nomics is a stupendous failure. The proof is that the democrats in congress are trying to extend unemployment benefits for the second time without paying for them. A competent president would have used free markets, lower taxes, and capitalism to turn the economy around long before unemployment benefits had to be extended twice.

According to the Wall Street Journal, the states give up to 26 weeks of unemployment benefits. The first extension by the federal government extended benefits up to 99 weeks. The second extension would be for four or five more months. All this expenditure increases the federal deficit, further killing our economy. According to CBS news (July 2, 2010) we have 14.5 million people unemployed, 8.6 million forced to work part-time, and 1.2 million who have given up looking for work – all total about 24.5 million people are getting no paycheck or a reduced paycheck. A competent president, using capitalism, would have turned the economy around and created jobs instead of forcing people on unemployment welfare for almost three years.

Dick Morris (06/28/10) made an analogy, which I will paraphrase and expand. Obama has been bleeding the sick economy with socialism, just as the ancient barber-surgeon used to bleed a sick patient with his evil tool, the scarificator. As the economy gets sicker under socialism, Obama's answer is to bleed it more, possibly to death, just as the ancient barber-surgeon used to bleed his unresponsive patient more and more until he or she needlessly died. Socialism is evil. Socialism will not save this country - liberty, freedom, and capitalism will.

Obama had a historic opportunity to respond to an economic crisis with liberty and free market economics. He could have brought back the textile industry, the toy industry, the steel industry, the car industry, electronics, the computer industry, and every other industry that has fled overseas. With good economic policy, the economy would have taken off like a rocket and tax revenues would have gone up over time. Prices would have started to fall and businesses that have left the country would have been brought back.

We could have increased our standard of living. We could have ensured ourselves of being a superpower for another 200 years.

Instead, we have no jobs, astronomical debt, and more and more people dependent on the government because socialism cannot create jobs like free markets and capitalism can.

Amazingly, Obama, Reid, and Pelosi are paying for all their socialism with money the government doesn't have, and is thus running the National Debt up by billions and billions more dollars.

National Debt
The National Debt is over 13 trillion dollars (UsdebtClock.org). President Obama, in his first year of office, has spent more of our money than all previous 43 presidents combined. The debt will take up more than 60% of the Gross Domestic Product (GDP) in 2010 according to the congressional budget office. A graph by the International Monetary Fund suggests that the US National Debt could reach 100% of GDP before 2015. The National Debt is increasing by over 4 billion dollars per day (brillig.com/debt_clock). Every worker in America owes more than $82,000 in National Debt (defeatthedebt.com).

Harvard and Columbia trained historian, and author of the book Nullification, Thomas E. Woods, Jr., warns us about the National Debt. When interviewed on the Glenn Beck show he said, “We've got 100 trillion dollars of unfunded liabilities in terms of Social security and Medicare for the future, which makes every household of four in the hock on top of their existing taxes another 1.3 million dollars, so we've got the age of the negative millionaire we have now entered … these people who are in charge of these systems have ruined the lives of the younger generation. They'll never be able to pay their way out of this."

Greece is a Socialist Warning to the USA
Greece has followed the worst combination of economic policy, socialism and corruption. In 2010, the entire country is going bankrupt. There is rioting in the streets because people are losing their government pensions. Do not let socialist governments control your pension money. They go broke and your pension disappears. This is a clear warning to the USA not to spend beyond it’s means, to increase transparency, and to reduce corruption.

California is a Socialist Warning
California should be a warning to everyone. California followed democratic-party-socialist economic policy and now they are bankrupt. When will people learn? The California legislature, because socialists rule, refuses to cut spending. Thus, the Governor recently (July 2010) had to take the drastic measure of cutting government paychecks down to minimum wage for 200,000 government workers. Previously, California Governor Arnold Schwarzenegger reached tentative deals with labor unions to reduce pensions and retirement benefits for state workers. The lesson is that if you give your money to the government for your retirement, prepare for the government to go broke and squander it.

Health Care is Already Communist
Our health care is already communist. Physicians are under wage and price controls because of Medicare and Medicaid. Patients have no power anymore. Central planning of health care has taken over and the government already denies care “regardless as to medical necessity” – an actual quote from Medicare. Medical decisions are being based on politics instead of what is good for the patient. Central government bureaucracy has already demonstrated it's incompetence all over of the world. Be warned. You may not be aware of this in health care until you are sick or dying and need your life saved. The “Army of the Seriously Ill” is small at any one time, thus they are not politically powerful. You must stand up against socialism and communism in health care when you are healthy, because when you are ill, it will be too late. We must give power back to patients, doctors, and nurses. And, we must take back control of the socialist research system we now have in place, if we really want to cure cancer and other diseases.

"In the book '1984,' George Orwell created a society in which the people were powerless under an oppressive government. In 2010, Barack Obama created ObamaCare in which patients and doctors will be powerless under oppressive government-run health care.

Government-run health care makes doctors violate their Hippocratic oath. The original Hippocratic oath says, "I will prescribe regimens for the good of my patients according to my ability and my judgment...." It does NOT say that doctors will prescribe based on some government panel that is years behind because of bureaucracy and incompetence.

Socialist Warning
How do you plunge a country into socialism and communism? With bad economic policy. You take away jobs with bad government and then the masses turn to the government for help, because the private sector has been destroyed by that very same bad government. This is exactly what is happening under the Obama administration.

May people think this is being done intentionally. Congresswoman Maxine Waters (Democrat, California) stars in a hilarious youtube video (http://www.youtube.com/watch?v=OrA9zj94NuU) in which she appears to reveal her socialist ideals. Unfortunately, the left wing of the democratic party is socialist and unions and democrats have united as a socialist force in America.

Here is a warning by Wayne Allyn Root, the Libertarian Candidate for President; he wrote: "…Obama is following the plan of Cloward & Piven, two professors at Obama’s Columbia University. In 1966, they outlined a plan to socialize America by OVERWHELMING the system with government spending and entitlement demands."

Ezra Taft Benson Warning
Ezra Taft Benson was secretary of Agriculture for President Eisenhower’s administration when he met with Nikita Khrushchev, who led the Soviet Union during the Cold War. Taft gave a speech in which he said, “As we talked face-to-face, he [Khrushchev] indicated that my grandchildren would live under Communism. After assuring him that I expected to do all in my power to assure that his, and all other grandchildren, will live under freedom, he arrogantly declared, in substance: ‘You Americans are so gullible. No, you won't accept communism outright. But we'll keep feeding you small doses of socialism until you finally wake up and find you already have communism. We won't have to fight you; we'll so weaken your economy until you fall like overripe fruit into our hands.’”

Socialist Warning
Obama’s majority congress has turned to socialism on a scale never seen before and spent more money than all previous administrations combined, sending our country into debt so deep, that further economic crises are inevitable, which will raise cries for more socialism, which will cause our country to circle of the drain of inevitable communism.

When we turn to socialism instead of capitalism, our personal liberties are flushed down the toilet. Under socialism, power is transferred from the people to the government. I fear it is almost too late to reverse the slide from socialism into communism. Our country was meant to be run by We the People, not by socialism or communism.

We Need Laws and Constitutional Amendments
According to an April, 2010, Rasmussen poll, 60% of adults believe capitalism is the better system, while 18% think socialism is the better system. Freedom loving people need to take over our country again and pass the following concepts into law on the national level and on every state level. Then we need to pass constitutional amendments. If we do not do this now, it will soon be too late. We the People of the United States of America need congress to pass the following principles into law:
1. The USA will never become a socialist country
2. The USA will never become a communist country
The politicians who oppose such legislation needed to be voted out to preserve freedom and liberty.

ObamaNomics is a stupendous failure. The proof is that the democrat congress is trying to extend unemployment benefits yet again. A competent president would have used free markets, lower taxes, and capitalism to turn the economy around long before now. Dick Morris (06/28/10) made the perfect analogy, which I will paraphrase. Obama has been bleeding the sick economy with socialism, just as the ancient barber-surgeon used to bleed a sick patient with his evil tool, the scarificator. Tea Party Patriots - Please Start “Tea Party Freedom Fridays” in Your Neighborhood

We have come up with a way to keep the Tea Party alive, growing, and recruiting. We started “Tea Party Freedom Fridays!”

“Freedom Fridays” are weekly events that take place in local restaurants or pubs, usually around “happy hour.” The event starts at 5:30 pm, when people start to gather, order food and drinks, and socialize with fellow patriots. The restaurants let us use their “back rooms” for free to get our business. Around 6 p.m. the meeting is started by the Master of Ceremonies. We say the pledge of allegiance, read our mission statement, and make any pertinent announcements. Then, we introduce our speakers. There are usually only three or four speakers and we limit them to two minutes each. By 6:30 we are done.

Then, there is a break, and people may pay their bills, socialize a bit more, and leave because we know their time is valuable. However, for those who want to stay longer there is an Open Microphone session.

When it’s time for Open Microphone, people can talk about any Tea Party related topic for one minute. Our Master of Ceremonies goes around the room controlling the microphone by imposing the “one-minute” rule. Surprisingly, in our experience, almost everyone stays for the Open Microphone session. People want to talk because they are so troubled by what is happening to our country.

This less-formal, more casual, social atmosphere is bringing us together. We are also attracting a diverse crowd and are getting people to become more interested in the Tea Party. We get many new people at every Freedom Friday meeting who want to learn about the Tea Party’s core values of:

1. Fiscal Responsibility 2. Constitutionally Limited Government, and 3. Free Markets.

We add the new people to our e-mail list for all our other activities: rallies, flag waves, educational meetings, and business meetings. We are also connecting everyone on Facebook.

WE NEED YOUR HELP!!! Our vision is to have “Freedom Fridays” taking place in every city or town in every state all across this great nation. We must do this if we are going to save freedom and liberty in our country.

All you need is a restaurant with a back room. One person can run the entire event. Our Master of Ceremonies brings a portable wireless public address system ($119 from CheapBandGear.com), sign-in sheets, and a homemade “Tea Party Freedom Friday - Open to the Public” sign to tape on the door.

The events are publicized by our local Tea Party’s advertising committee that sends out announcements via e-mail, Facebook, local newspapers, and the radio.

If some of you will step up to the plate in your hometown, we will guide you through the process…we are here to help you get this done. We have to start meeting weekly to save this great country. We have to talk about politics—we can no longer politely avoid this topic. We MUST take our country back for the people.

We need to network via e-mail, Facebook, Twitter, AND in person, if we are going to take this country back for the people.

The Tea Party is a huge success, and we are making a huge difference in elections. Let's continue to grow. However, lovers of big oppressive government and socialism are counting on us to get weary and give up. Remember, "We must all hang together, or assuredly we shall all hang separately," as Ben Franklin said at the signing of the Declaration of Independence on August 2nd 1776.

Tea Party “Freedom Fridays” - Rules for Patriots

We the people are coming. We are going to stop punitive taxation, deficit spending, and socialism. We are going to meet every week until freedom is saved.

Here’s a step-by-step guide to starting Tea Party “Freedom Fridays” in your neighborhood. The purpose of Freedom Fridays is to recruit new Tea Party members, educate the attendees, and to energize Tea Party Patriots.

Organizing for “Freedom Fridays”
1. Get a few Tea Party members together and encourage them to start Freedom Fridays.
2. Find a restaurant where a function room is available, and that has a public address system, or order a portable PA system. We ordered a wireless PA system for $119 from here:

3. Arrange with the owner to have Freedom Fridays starting at 5:00 or 5:30 p.m. (we use 5:30 - basically right after work) every Friday. Focus on November, then 2012, and then go for eternity if necessary to prevent the land of the free and the home of the brave from being taken over by socialism.
4. We found that most restaurants in our town will allow free use of their function room if you are likely to have 20 or more people attend and order food and drinks. We created a list of many restaurants that will work with us as we grow.
5. Advertise the event via e-mail, Facebook, Twitter, newspapers, radio, and even TV if you can get it. We need non-stop notices about Tea Party events in community calendars, on the Internet, and in the news.
4. Create a handout that explains the “Freedom Friday” movement, explains your local Tea Party, and lists all the important Tea Party contact information. We also placed the Tea Party Mission Statement at the bottom of the handout.
5. Create sign-in sheets to pass out at the meeting. YOU MUST RECRUIT new people at every meeting by getting email addresses, phone numbers, and Facebook contacts.
6. Create a sign (or signs) that will go inside the restaurant and point to the meeting room. This can be as simple as a piece of paper saying “Tea Party Freedom Friday.”
7. Create an agenda for the Master of Ceremonies and speakers to follow at the meeting.
Running the “Freedom Friday” Meeting
1. The people running the Freedom Friday meeting need to arrive at least 30 minutes early to go over the agenda, set up, test the microphone, and check the arrangements of tables and chairs.
2. Some of the first arrivals should be asked to become “greeters” and pass the handout out to people as they come in. No one should be left to wonder what the Tea Party is about or should be confused; everyone should be greeted, given a handout, and told they can order food and drinks.
3. Use the microphone periodically to announce that people should order drinks and food and to get settled in for the upcoming short program.
4. Our Master of Ceremonies at the first Tea Party “Freedom Friday,” Lin DiCesare, did a great job. She was an artist. She watched the crowd and occasionally used the microphone to ask if people had ordered. She helped the waiters/waitresses by asking people to raise their hand if they still needed to order. She foreshadowed what was going to happen by telling people that soon a program would begin, that there would be a break, and then later there would be an open microphone session for people who wanted to stay.
5. Lin DiCesare started the program by introducing Ginger Carlisle.
6. Ginger Carlisle read a mission statement, she had edited for the occasion, with great passion.
7. Dr. Bradley Hennenfent described what “Freedom Fridays” are all about, and then spoke for 2 minutes on health care.
8. Lin continued on by introducing each speaker, who had been instructed to speak only about 2 minutes.

Speakers included:

1. Lin DiCesare (Native American and Retired USAF SSgt)
2. Mike Brown (libertarian)
3. Ginger Carlisle (businesswoman)
4. Carlos Candelario (entrepreneur)
5. Kevin Carlisle (physician assistant)
6. Verwayne Greenhoe (known as the "common sense guy").

Our goal was to entertain the crowd, inform the crowd, and inspire the crowd to take action to make a difference in all future elections. We went fast and short with speeches because we wanted people to know that we know their time is valuable. Our passionate and dynamic program was finished in 1/2 hour. (Next time we are going down to only 4 speakers, so there will be more time for announcements.)

Lin DiCesare thanked everyone for coming and announced that a break would now take place for people to pay their checks for their food and drinks, and that after the break, anyone who wanted to stay for the Open Microphone session could. We requested that each Open Microphone Speaker limit their speech to one minute.

This is where our Master of Ceremonies was a great artist again. She walked around with the wireless microphone and let people who raised their hand talk for one minute. When people went over the time limit, she “managed” them with non-verbal clues to get the microphone back. Some of these one-minute speeches were spine tingling, and made you very proud to be an American.

Our First “Freedom Friday” was a Huge Success
The very first Tea Party “Freedom Friday” was a huge success. We had 55 people, which filled the banquet room we were using. We collected emails for 10 to 15 brand new members for the Tea Party.

Virtually everyone, to our surprise, stayed for the Open Microphone session. People seemed very grateful to get to say a few words. And, people seemed very grateful to meet others who think like they do.

Afterwards, many people networked over the issues that were most important to them. We are now committed to having Tea Party “Freedom Fridays” every Friday until freedom reigns.

Future Plans
When our first “Freedom Friday” location gets to standing room only, we are going to ask the crowd to help us split, and expand to two locations, by getting 20 volunteers or so to commit to show up at the new location the next week.

After the second location gets full, we are going to ask the crowd to help us expand to three locations.

And, using the Internet, we are hoping to take the idea of Tea Party “Freedom Fridays” and Tea Party “Freedom Saturdays” national. Patriots must start meeting on a regular basis! We must grow at exponential rates before November. Patriots must all donate at least one day a week to freedom, or we are going to lose freedom forever.

If you are a Tea Party member, supporting the Tea Party messages of taxed enough already, stopping wasteful government spending, and stopping socialism, you are free to use “Tea Party Freedom Fridays” or “Freedom Fridays” information or logos for these events.

The same goes for “Tea Party Freedom Saturdays” or “Freedom Saturdays” for short. You are also free to create your own logos and materials as long as they are donated or shared with all Tea Party members with the ideals of lower taxes, limited government, less wasteful spending, and capitalism.

We are riding a wave, that wave is growing, and we will have a tidal wave in November, in 2012, and beyond.

Mission Statement
We the people of the Tea Party want to end the era of punitive taxation, reckless deficit spending, and disregard of our human rights by our local, state, and federal governments. We invite all of you to insist on accountability, fiscal responsibility, constitutionally limited government, and free markets. We will defend freedom and liberty. Together, we will save this country from socialism within, and enemies without.

Obama Lied
As a physician and economist, I listened to the health care reform debate with great interest. I got interested in the Tea Party after Barack Obama lied to me over and over again.

1. Candidate Obama said at least eight times that all health care reform negotiations would be on C-span - blatant lies.
2. Obama promised to be “postpartisan” - lie.
3. Obama said his “door would always be open” to new ideas for health care reform. Well, I knocked on that door, at all levels of government, over and over again and it was always closed - lie.
4. Obama said all the best ideas were on the table - lie.
5. Candidate Obama insisted during the campaign that he would not force people to buy insurance against their will - lie. 6. Obama said he would not sign a bill that adds “one dime” to our deficits. Well, Tuesday, (May 11, 2010) the Congressional Budget Office (CBO) released a report indicating that the bill 'will likely cost about $115 billion more than the original cost projections.' In addition, the bill intentionally did not count the cost of health care providers. - lie.
ObamaCare is as certain to go broke as Medicare and Medicaid, and rationing will ensue, based on politics instead of what is best for the patient. The most offensive thing about ObamaCare was that a better way was so obviously available, a way that would have empowered patients, lead to greater innovation, and saved lives, instead of causing death and suffering. We, free people, deserved better than ObamaCare.

Legal Stuff
I have done my best to protect the concepts of “Freedom Fridays” and “Freedom Saturdays” and many other catchy phrases for Tea Party Members. If you are a Tea Party patriot feel free to use these things to save our country.

We must start meeting weekly for freedom. If we do not, freedom and liberty will give way to socialism.

The Contract from America

We, the undersigned, call upon those seeking to represent us in public office to sign the Contract from America and by doing so commit to support each of its agenda items, work to bring each agenda item to a vote during the first year, and pledge to advocate on behalf of individual liberty, limited government, and economic freedom.
Individual Liberty

Our moral, political, and economic liberties are inherent, not granted by our government. It is essential to the practice of these liberties that we be free from restriction over our peaceful political expression and free from excessive control over our economic choices.
Limited Government

The purpose of our government is to exercise only those limited powers that have been relinquished to it by the people, chief among these being the protection of our liberties by administering justice and ensuring our safety from threats arising inside or outside our country’s sovereign borders. When our government ventures beyond these functions and attempts to increase its power over the marketplace and the economic decisions of individuals, our liberties are diminished and the probability of corruption, internal strife, economic depression, and poverty increases.
Economic Freedom

The most powerful, proven instrument of material and social progress is the free market. The market economy, driven by the accumulated expressions of individual economic choices, is the only economic system that preserves and enhances individual liberty. Any other economic system, regardless of its intended pragmatic benefits, undermines our fundamental rights as free people.
1. Protect the Constitution

Require each bill to identify the specific provision of the Constitution that gives Congress the power to do what the bill does. (82.03%)
2. Reject Cap & Trade

Stop costly new regulations that would increase unemployment, raise consumer prices, and weaken the nation’s global competitiveness with virtually no impact on global temperatures. (72.20%)
3. Demand a Balanced Budget

Begin the Constitutional amendment process to require a balanced budget with a two-thirds majority needed for any tax hike. (69.69%)
4. Enact Fundamental Tax Reform

Adopt a simple and fair single-rate tax system by scrapping the internal revenue code and replacing it with one that is no longer than 4,543 words—the length of the original Constitution. (64.90%)
5. Restore Fiscal Responsibility & Constitutionally Limited Government in Washington

Create a Blue Ribbon taskforce that engages in a complete audit of federal agencies and programs, assessing their Constitutionality, and identifying duplication, waste, ineffectiveness, and agencies and programs better left for the states or local authorities, or ripe for wholesale reform or elimination due to our efforts to restore limited government consistent with the US Constitution’s meaning. (63.37%)
6. End Runaway Government Spending

Impose a statutory cap limiting the annual growth in total federal spending to the sum of the inflation rate plus the percentage of population growth. (56.57%)
7. Defund, Repeal, & Replace Government-run Health Care

Cloud, I am with you.

Doctors are working long hours and then studying long hours after work. Most of them don't have time to breathe. They lack the time to get into politics, which is usually a losing battle for them. Look at the health care (ObamaCare) bill. All of us who put time and energy into stopping it in favor of "Patient Power" reform were defeated. Every doctor I know wanted to do something, but felt helpless, and didn't have the time.

And, we were betrayed by the AMA.

We need to organize and make things easier for all physicians and all freedom lovers. Doctors want to put patients first. Doctors wanted to empower patients, not third parties. Some new organizations have sprung up, like Docs4PatientCare.org, which I have high hopes for.

Docs4PatientCare.org intends to protect the doctor-patient relationship and keep bureaucrats from coming between patients and doctors.

I am begging you, stop ObamaCare. Health care has been life and death to me since the death of my first best friend from muscular dystrophy as a sophomore in high school. It has been life and death to me since I worked in a hospital over summer break from college and my first patient suffered pain, agony, and distention from lethal colon cancer. It has been life and death to me since I entered medical school 30 years ago and became a warrior against illness and injury.

In these modern times, and with our modern technologies, the power in health care should be flowing to patients, doctors, and nurses so that they can save more lives. Instead, with ObamaCare, the power is going to third parties.

People will die. You might die. Some of your loved ones might die. Future patients are sure to die.

This is not like college where education was all good and fun. This is not like the first two years of medical school, when professors taught what they researched in laboratories and had no urgency about it. This is crunch time, this is third and fourth year medical school being taught by actual doctors who have seen patients twisting in agonizing pain, and fighting against all odds to live. This is the actual practice of medicine by attending physicians where patients live and die based on your decisions. Everything is life and death now. The game has changed.

It's time for the truth.

Sarah Palin was right about the "death panels."

Senator Grassley was right about when he said they're "...going to pull the plug on grandma."

“Death panels” are government bureaucrats. Death panels are when third parties stand between you and your doctor. Death panels are when you do not have control over your own body. Death panels are when third parties deny you the treatments doctors have prescribed for you. Death panels are when the Government takes your money from you, redistributes it, wastes it, runs out of it, rations it, makes you stand in line for health care, and ultimately denies you the care you need.

Recently five doctors recommended an antibiotic and Medicare still denied it. Medicare remember, denies you treatment "regardless as to medical necessity." Medicare is no way to run health care. God help you if your life actually depends on the government, Medicare, or Medicaid, or any other third party. Insurance companies that become too powerful via crony capitalism do the same thing - "death panels" again.

There is a vastly superior way to do health care reform. It’s called "Patient Power." We can have patients have more control over the money so that they get what they want, and get what their doctors and nurses want them to have, instead of what corrupt and selfish third parties want. Third parties want money. Patients want to live. Doctors and nurses want to help.

Suddenly today, we have the technology to vastly improve the science of medicine by setting up social networking for physicians, nurses, and all allied health care professionals. Health care professionals have secret inside medical information that needs to be made public, that can direct research, and that can save your life.

We can use the social networking of doctors to eliminate all the overhead expenses wasted by the government and insurance companies to establish protocols for what they will pay for. We can use this social networking to determine reimbursement based on science instead of politics. This will lower costs for all the third parties. This will end the waiting and delays. This will save lives. Bureaucrats are incompetent to make medical decisions and my reforms would kick them out of the decision-making process.

We can have price transparency, which is a bipartisan idea, and should have been the one good idea to come out of President Obama's health care summit. I am sure that many or all Republican doctors in Congress would agree with Representative Dr. Steve Kagan, a democrat, who introduced a bill in congress that is languishing in committee called The "Transparency in All Health Care Pricing Act of 2010."

Dr. Kagan’s bill, according to his website: "would finally allow patients to see the price of a pill before they swallow it, allowing patients to receive the highest quality care at the lowest possible prices." Similarly, the senate doctors, Dr. Tom Coburn and Dr. John Barrasso, both republicans, say on their website that: "For a vibrant health care market to function properly, patients must know what services cost...." I am totally behind price transparency as the first, and most important, step in health care reform. It will empower patients.

My friend had open heart surgery. He was never told the price of anything in advance, not during the pre-surgery period, the hospital stay, the post-surgery recover at home, or during rehabilitation. It was only when he saw his bills after all was said and done that he discovered highly questionable charges. There were many charges he, and I, thought were ridiculous. Charges that would never happen if prices were public.

I had a complete blood count, commonly known as a CBC, last year. No one involved could tell me the price. "What do you care?" the entire health industry says, insurance pays for it. Well guess what? I do care. You cannot drive prices down if no one knows the prices.

Sometimes I use coupons. Sometimes I read ads. I use that information to help buy things for less. In health care, you cannot do this. Patients cannot spend their money from Medicare, Medicaid, insurance companies, or out of their own pocket wisely if they don't know what anything costs.

Please stop ObamaCare. Please pass the bipartisan "Transparency in All Health Care Pricing Act of 2010" instead. This will drive prices down, allowing more health care at lower prices, which will in turn increase access to care. Price Transparency will empower patients and start them down the road to "Patient Power," which is where we really need to be.

I have a degree in economics. I have a medical degree. What we need to save the most lives possible is to reduce prices and improve medical science. We have outstanding ways to do both of these things with the latest Internet technologies and information technologies. None of these great ideas are in ObamaCare. ObamaCare is not the best care. I know better ways exist. That is why I am against ObamaCare. It's life and death to me; not politics. I am non-partisan.

I dramatically titled this “ObamaCare Will Kill Future Patients Compared to What Could Be. Please Stop ObamaCare” for a reason. Every time you tie the hands of doctors and nurses by letting third parties dictate care, people on the edges will die. People who need action right now to live, who are delayed by third party bureaucracies will die. People who have to appeal to third party panels to get life saving drugs or procedures and are denied will die. Patients severely traumatized, severely injured, or severely ill, who are on the verge of death, who need cutting edge medical treatment or innovation will die.

A patient under the care of another doctor, who has been seriously injured, recently called me. She lamented, “My doctor knows what he wants to do to help me, but all my care is being dictated by third parties.” She is needlessly suffering.

We don’t need third parties telling doctors what to do. We don’t need ObamaCare panels telling doctors what to do. We don’t need insurance company panels telling doctors what to do. We need doctors and nurses who save lives daily telling us what to do.

We have 800,000 doctors and three million nurses. We can hook them all together with a new thing called the Internet. We have the technology now to let them all rank the science behind medical treatments and to set up all the reimbursement decisions in advance. We can eliminate all the third party red tape and free up doctors, nurses, and allied professionals to save people’s lives. Instead, ObamaCare will put roadblocks and paperwork between your doctors, nurses, and you.

Health care reform is no joke to me and it shouldn’t be to you either. Your life is at risk, your kid’s lives are at risk, your loved one’s lives are at risk. Let people who really know how to reform health care do it, instead of politicians. Reform health care in a way to maximize the science, to drive prices down, and to maximize innovation of cures.

For example, a fabulous new anti-cancer pill may appear in the medical literature. Randomized controlled studies may show that it works to extend life. Your wonderful and well-trained physician may be ready to give you this medication based on the latest and greatest medical studies, because without it you will be dead in weeks. But, he or she can’t. The drug is not on some list yet, it hasn’t passed through some committee yet. You will die - killed by the government or an insurance company panel of bean counters.

An incredible new antibiotic may be invented. It has virtually no side effects compared to existing antibiotics. Randomized controlled studies show that it works for your disease. Your doctor prescribes it. But, you can’t have it. It is not in the drug compendia yet. The horrible infection devastates your body as you fight the government. Many doctors and nurses write letters supporting your cause. But the government can’t move fast enough. Too bad for you. Your infection becomes a chronic disability.

When there is one minute left, and the decision needs to be made that will save your life, who do you want making that decision? A government bureaucracy, an insurance panel, or the physician at the peak of his or her career?

You have a choice. We can institute health care reform that is sure to improve the science of medicine, that will share what all doctors and nurses know with you, that is sure to enable health care providers to react quickly and efficiently, that is sure to save more lives than ever before, or we can hang the albatross of ObamaCare around our necks.

The most offensive thing about ObamaCare is that there is so obviously a better way to do health care reform. A way that empowers patients, doctors, and nurses, instead of third parties, and a way that will save more lives.

Bad policies in health care are already causing a maldistribution of doctors that hurts everyone. Bad policies are causing ridiculous red tape for doctors and nurses, the wrong research to be done, and unnecessary deaths. I see how government stupidity kills people every day.

Consider it this way. We can unleash on humanity a perfect new vaccine developed by doctors and scientists that will wipe polio off the face of the earth, or we can let politicians produce a flu vaccine that is not effective, that we don’t really need, and has side effects that will destroy lives.

Please save a life in the future. Act today. Call politicians. Spread this essay to everyone you know. Freely re-distribute it. I give it to you. I know how we can achieve medical care utopia, and that the answer is not ObamaCare.

Kill ObamaCare before it kills someone you love. Do it right. Put patients in charge with “Patient Power” instead.

Why do I do all this writing on health care reform? Because I will save more lives by defeating ObamaCare than any one physician could ever save working for a lifetime seeing patients. There is a far better way: “Patient Power” health care reform.

Price Transparency in Health Care Needs to be Passed Now

There are "Patient Power" ways to reform health care that will save far more lives than ObamaCare ever will. And, the science of medicine can be vastly improved if we empower patients, doctors, and nurses instead of third parties.

I encourage you to stop ObamaCare. However, I do support Dr. Steve Kagan's (Democrat, Wisconsin 18th) "Transparency in All Health Care Pricing Act of 2010" (H. R. 4700), which has 45 co-sponsors. This bill is an excellent bipartisan compromise. It basically echoes what Dr. Tom Coburn (Republican Senator from Oklahoma) mentioned at the Health Care Reform Summit. Price transparency will EMPOWER PATIENTS. Republicans and democrats like Dr. Steve Kagan on are board with empowering patients.

WASHINGTON, D.C.- Congressman Steve Kagen, M.D. introduced new legislation today [February 25th, 2010] that would create a transparent and highly competitive medical marketplace. The "Transparency in All Health Care Pricing Act of 2010" would finally allow patients to see the price of a pill before they swallow it, allowing patients to receive the highest quality care at the lowest possible prices.

Specifically, the bill says that any individual or business entity that offers health care related products or services must at all times openly disclose all of their prices, including on the Internet.

"When was the last time you bought anything without knowing what it cost?" Dr. Kagen asked. "My patients, and my constituents, want to know the price of a pill before they swallow it - and certainly before they buy it," said Dr. Kagen. "They want to go shopping for the best medical products and services at the lowest possible prices. It is the American way."

"Prices for our prescription drugs, hospital services and health insurance premiums have shot through the roof, primarily because of an opaque, non-transparent medical marketplace. Everywhere I go, people are saying, 'Just show me the price, so I will know if I can afford it.' Everyone knows how much they pay for a cup of coffee, and it is time we finally have a chance to see all of the prices an insurance company has accepted as payment in full for their services."

To provide for transparency in health care pricing, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Transparency in All Health Care Pricing Act of 2010'.

SEC. 2. TRANSPARENCY IN ALL HEALTH CARE PRICING.

(a) In General- Any and all individuals or business entities, including hospitals, physicians, nurses, pharmacies, pharmaceutical manufacturers, dentists, and the insurance entities described in subsection (d), and any other health care related providers or issuers that offer or furnish health care related items, products, services, or procedures (as defined by the Secretary of Health and Human Services) for sale to the public shall publicly disclose, on a continuous basis, all prices for such items, products, services, or procedures in accordance with this section.

(b) Manner of Disclosure- The disclosure required under subsection (a) shall--

(1) be made in an open and conspicuous manner;

(2) be made available at the point of purchase, in print, and on the Internet; and

(3) include all wholesale, retail, subsidized, discounted, or other such prices the individuals or business entities described in such subsection accept as payment in full for items, products, services, or procedures such individuals or business entities furnish to individual consumers.

(c) Penalties- The Secretary of Health and Human Services may investigate any and all individuals or business entities that fail to comply with the requirements of this section and may impose on such individuals or business entities civil fines, or other civil penalties, as determined appropriate by the Secretary.

(d) Insurance Entity Described- For purposes of this section, an insurance entity includes a health insurance issuer with respect to the offering of health insurance coverage, including in the individual market and small and large group market (as such terms are defined in section 2791 of the Public Health Service Act), a plan sponsor with respect to the offering of a group health plan (as defined in such section 2791), and entities responsible for the administration of governmental health plans (including the Centers for Medicare & Medicaid Services with respect to the Medicare program under title XVIII of the Social Security Act, State agencies responsible for administration of State plans under the Medicaid program under title XIX of such Act, or State child assistance plans under the State Children's Health Insurance Program under title XXI of such Act, and the Office of Personnel Management with respect to the Federal Employees Health Benefits Program under chapter 89 of title 5, United States Code).

Please stop ObamaCare. I have seen the “death panels.” They are Medicaid, Medicare, and the Veterans Administration. They share one thing in common, they are run by the government. The “death panels” are government bureaucrats who come between you and your physician and, after being fiscally incompetent, ration, delay and deny care.

People who like government programs surely have never had to fight for a patient’s life or health care under these systems. Government health care is better than nothing, but clearly, it is not the best care. Medicare can deny a patient an antibiotic, even if five doctors recommend it. Medicare can deny a cancer treatment simply because it hasn’t made it on a list yet. Medicare denies patients, to quote Medicare: “regardless as to medical necessity.”

Medicare and Medicaid are no way to run health care. We know government health care is defective. We are the richest, most powerful country in the world. We have technology now that has never before existed, so let’s create something better than any health care system in existence now.

When Insurance companies succumb to crony capitalism the same thing occurs - “death panels” again. The “death panels” are insurance companies coming between you and your doctor. On the other hand, insurance companies that work properly are a driving force behind the greatest health care in the world, which we have in America today.

Health care reform seems so easy to us physicians who have seen patients die or suffer because of the health care system. The solution is to make patients, doctors, nurses, and allied health care professionals more powerful and the Government and crony capitalism less powerful.

Sarah Palin said on Facebook: “The America I know and love is not one in which my parents or my baby with Down Syndrome will have to stand in front of Obama’s ‘death panel’ so his bureaucrats can decide, based on a subjective judgment of their ‘level of productivity in society,’ whether they are worthy of health care. Such a system is downright evil.”

Then, President Obama proved Sarah Palin right when he made a deal with Union leaders, so that they would not have their Cadillac Health Care plans taxed like other Americans. Apparently, non-union members can suffer and die on lower quality health care plans, while unions members “based on a subjective judgment of their ‘level of productivity in society,’” are deemed more worthy than everyone else - because they are mostly Democrats.

I am not partisan. Both parties are good and bad. Both have good ideas and bad ideas. They are not important to me. Patients are. Socialized medicine is not the best system. Crony capitalism is not the best system either. The answer is to make patients and health care providers more powerful. This can be done. But the best ideas for health care reform are not on the table yet.

Needless to say, I will not be trusting those people for any future fact checking. I didn’t see any evidence that they asked the people who would actually know the inside secretive information by which our current “death panels” function - the doctors and nurses.

Perhaps the best comment I read on this controversy was on a blog:

That blogger, pen-named Uffda, is exactly right. Government health care invariably goes bankrupt as Medicare and Medicaid have. Government health care is also incompetent, corrupt, inefficient, stifling of innovation, and results in rationing, lines, denials, delays, and the figurative “death panels” that Sarah Palin wrote about.

That’s why socialized medicine is so evil. Crony capitalism is also evil. Stop both those evils and put patients, doctors, nurses, and allied health care professionals in charge, not third parties.

Sarah Palin also wrote that “Rep. Michele Bachmann highlighted the Orwellian thinking of the president’s health care advisor, Dr. Ezekiel Emanuel, the brother of the White House chief of staff, in a floor speech to the House of Representatives. I commend her for being a voice for the most precious members of our society, our children and our seniors.”

I have read Dr. Ezekiel Emanuel’s articles in the medical literature and I agree with Michele Bachmann and Sarah Palin on this issue. I think he has horrible ideas. The worst part is that he doesn’t understand why, claims he is misquoted, and is taken out of content. He seems to be a clueless collectivist and I blame him for many of the deaths that occur every day in America because of the policies he writes about. He should not be a “bioethicist” for our NIH.

Sen. Chuck Grassley told us to fear that the government would "pull the plug on grandma." He was right for all the same reasons that Sarah Palin was right about “death panels.” Government health care takes Grandma’s health care money in taxes all her life and then when she wants to use it for her needs, it’s too late, it has been redistributed to other people, and her health care is rationed, delayed, and denied by the government.

I know elderly patients. I know they don’t want to die early because of a bad health care system. People want to live. People fight to live. People are beautiful and uplifting in their struggle to survive.

Obama dismissed “pulling the plug on Grandma” as dishonest. He said:
“I just lost my grandmother last year. I know what it’s like to watch somebody you love who’s aging deteriorate, and have to struggle with that,” Mr. Obama said. “So the notion that somehow I ran for public office, or members of Congress are in this so they can go around pulling the plug on grandma? I mean, when you start making arguments like that, that’s simply dishonest.”

However, “pulling the plug on grandma,” on grandpa, on mother, father, brother, sister, child, wife, and husband is exactly what occurs under socialized medicine. It happens under Medicare right now because of bureaucracy, fraud, and waste, and because Medicare stifles innovation, science, and the free flow of information patients need to make decisions.

Obama famously said, when answering a question about a pacemaker in an elderly mother, “"Maybe you're better off, not having the surgery, but taking the pain killer." He scared to death many people who believe that Obama’s bureaucrats are going to take over life and death decisions from patients.

I want to thank you Sarah Palin, “The Greatest Truth about Health Care Reform” was spoken by you in 2009. We can only hope that you have single-handedly saved us from the “death panels” of socialized medicine, and of Medicare and Medicaid for all. “Death panels” will be created if we create an inept health care system - whether public or private.

I also want to thank Senator Chuck Grassley for telling people to fear “Pulling the plug on Grandma.” He couldn’t have been more correct.

My prescription for patients is to fight “tooth and nail” to have “patient power” health care reform passed. Your life is at stake.

It was widely reported that Danny Williams, head government official in Newfoundland, skipped ahead of the lines in Canada (a government single-payer system) and went to Miami Beach for heart surgery at Mount Sinai Medical Center. He wanted minimally invasive surgery that he could not get in Canada. "This was my heart, my choice and my health," Williams was widely quoted as saying. Mr. Williams was right to leave Canada, as innovation and choice slow down, and sometimes disappear, under government health care.

I have written a health care reform plan where all 800,000 doctors would rate medical treatments in advance of need, and where science would determine reimbursement, not politics.
